“These minutes of the Town of Carroll Select Board have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions and corrections by the Select Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSA 91-A:2.”

Board members present: David Scalley, Bonnie J. Moroney, Paul Bussiere.

The meeting was called to order at 7:00 p.m.by Chairman Scalley.

Members of the public present: Michael Hogan, Dianne Hogan, Debbie Szauter, Imre Szauter, Brian Mycko, Jeremy Oleson, Bill Smalley, John Trammell, Donna Foster, Mike Gooden, Kevin Fadden

Pledge of Allegiance

The Chairman called for a Moment of Silence for Carla Vaughan.

The Board announced the approval of bills and signing of manifests.

Selectman Moroney made a Motion to approve the minutes of 2/2/2016 as written and Selectman Bussiere seconded. The Motion passed unanimously.

Selectman Moroney made a Motion to approve the minutes of 2/8/2016 as written. Selectman Bussiere seconded and the Motion passed unanimously.

The Water Rates had been reviewed and it was recommended that they remain the same as they have been: Base - $33.00/quarter; Base Vacant - $16.68/quarter; Fixed - $6.25/quarter; Usage - $6.96/thousand gallons. Selectman Bussiere made a Motion to: approve the recommendation and Selectman Moroney seconded. The Motion passed unanimously.

The application for Town Hall Use Permit was continued from a previous meeting. Selectman Moroney reminded all that the large fundraiser held here in January brought up many questions about the soundness of the building and therefore safety of the people using it. She had requested that these concerns be addressed immediately as again, the concern is about public safety. During the discussion of this Permit, Selectman Moroney said she also wanted to bring up the use by the basketball program. She said she was at a meeting in the kitchen recently and there was a tournament or something going on with a lot of people. Even with all the doors closed the members still could not hear each other as children were running wild on the other side. After a while she went and spoke to them and it did get better, but it was still very noisy. She noted that the next day some minor damage was discovered in the boys’ and girls’ bathrooms downstairs. This has been sponsored by the Twin Mountain Parks and Rec for several years as it is actually a Whitefield Rec program (with Twin Mountain children involved) and there are not enough courts in Whitefield. Selectman Moroney said she wants to add to the form that the sponsor must be in attendance. The Secretary said for several years, someone from Twin Mountain Parks & Rec was there every day that the gym was used, but that hasn’t been the case in the last two or three years.

Fire Chief Jeremy Oleson reiterated the building does not have an Assembly Permit which it needs. There was confusion about who is responsible for procuring one and that one was required for every function, etc. It was clarified that only one is needed and the onus is on the Town to acquire it for the building. Chief Oleson said it is a State Permit. He stated he has the requirements and he does the inspections.

Michael Hogan suggested they turn the use of the Town Hall over to the Rec Dept., along with all events. Discussion took place and Selectman Moroney said she was referring only to the basketball program in her last remarks. It was also general consensus that it would not necessarily be good to do as it would be putting too much on that group.

There was a brief discussion about the removal of street lights from the intersection of Routes 3 and 302, and the letter the Selectmen had requested be written to get them returned. Though one light has been put back on, it was recommended they still send the letter. Therefore, Selectman Bussiere made a Motion to: sign and send the letter to the State DOT asking that the lights be returned. Selectman Moroney seconded and it passed unanimously.

Michael Hogan said if the State is reducing costs, the Town should consider it, too. He recommended changing all lighting to LED and said it would pay for itself in three years or so. Selectman Bussiere said he thought it would be a much longer time, but others said costs have been greatly reduced in the last few years. Mr. Hogan said he would look into changing regarding costs, etc. The Board thanked him.

Chairman Scalley asked Donna Foster to enlighten him about the Town property at the entrance to Foster’s Crossroads. Mrs. Foster said years ago when they tried to buy all the property from the Town (because the State had changed the location of Route 3), they got all but that piece as someone blocked its inclusion in the sale. She confirmed that it is the piece between Route 3 and the parking lot that the Chairman thought it was. She said it’s possible that at some time in the future, the purchase of it may be looked into again. Chairman Scalley thanked Mrs. Foster.

Hiring a Town Prosecutor was next and Chief Trammell said this would be for taking over all prosecutorial duties for the Town; anything to do with Court. He said this will be a tremendous asset citing the large amount of time even just waiting for a case to come up takes. He said this would free him up a minimum of ten hours a week as well as freeing up other officers. He said the attorney, Wendy Roberts, works for Whitefield and Lancaster and has done a great job for them. The Board stated that our legal counsel wants her to be a 1099 employee and Chief said he would advise her. The Board looked over the agreement and said they would like to change it from “part time employee” to “subcontractor” and the pay from “$240 weekly” to $12,000 annually. Chief Trammell again said he would present the changes to Ms. Roberts and let them know her response. Selectman Moroney made a Motion to: Accept the agreement with the changes noted. Selectman Bussiere seconded and it passed unanimously.

Selectman Moroney wanted to remind all about the Spaghetti Dinner and Raffle on Saturday, February 27, at the Town Hall to benefit the 250th celebration of the Town to be held in six years.

Selectman Bussiere asked if Greg Hogan had set up an appointment with the structural engineer to inspect the Town Hall and it was unknown as Greg was not in attendance.

Selectman Bussiere asked where they were regarding Building Permits, etc. Selectman Moroney said they know from much research that although there were numerous contradictions, they found that the Select Board can change fees and can replace the inspector. She suggested they get their “ducks in a row” and maybe put in a warrant article next year.

The Secretary was asked to send the agreement for Wendy Roberts to Town Counsel after the changes are made.

Mr. Szauter thanked the Board for approving their solar tax credit application.

Michael Hogan said he just looked on his phone at the Concord site and they are shutting off 3,000 lights, so maybe the Town should consider saving money also.

The question was asked about what goes into an Assembly Permit – and the Fire Chief stated it must comply with life safety code.

The next Selectmen’s meeting will be February 29, 2016 at 7 p.m. to allow Mike Gooden to set up the Historical Society exhibit for March 8, voting day.

As there was no further business, the Board was polled to go into non-public session, per RSA 91-A-3 for legal and personnel at 7:50 p.m. Selectman Bussiere, yes, Chairman Scalley, yes, Selectman Moroney, yes.

At the close of non-public session at 10:00 p.m., Selectman Moroney moved to return to public session and seal the minutes from non-public session. Selectman Bussiere seconded and the Motion passed unanimously.

Selectman Moroney made a Motion to adjourn the meeting and Selectman Bussiere seconded. The Motion passed unanimously. Chairman Scalley declared the meeting ended at 10:01 p.m.
