TOWN OF CARROLL ZONING BOARD OF ADJUSTMENT


MINUTES April 14th 2016
Members present were: Chairman-Paul Bussiere, Vice Chairman- David Scalley, Dianne Hogan and John Trammel
Members of the public:
Donna and John Foster, Mike Hogan Bill and Rena Vecchio.

The Public Meeting was called to order at 7.01PM by Chairman Bussiere and the pledge of allegiance was recited.
The board heard an application for a Variance from Fosters Crossroads represented by Donna and John Foster.
Donna Foster explained her project and why the need for a variance existed. Mrs. Foster explained that the tanks had to be replaced by state requirements. All necessary applications and licenses were in place and state approval, monitoring and sign off of the tank installation portion of the project is taking place. With the new tank placement came the ability to turn the existing pump stations 90 degrees. This would facilitate better customer use of the tanks and an easier, safer turning radius for people with trailers and campers. The placement of the overhead canopy would rotate 90 degrees to protect the users from the elements as they used the pumps. A corner of the canopy would be within the commercial zone keep out of a portion of the town road abutting the Fosters property. This concluded the presentation from the Fosters. The chair asked if any members of the board had questions. A member of the board asked if the orientation of the pumps could be located in the original location. The applicant explained that in order to facilitate entering and exiting, the location of the pumps had to be at the proposed location. Dianne Hogan asked the application(s) how many poles would be supporting the overhead canopy. The applicant stated 4. Dave Scalley asked the applicant(s) how many fuel pumps the new orientation would allow. The applicant stated 2 with 2 nozzles each.
Paul Bussiere asked the applicant(s) about lighting. The applicant explained that 8 LED units. Dave Scalley asked the applicant about wiring and the applicant(s) stated that the wiring would be along the new tank location. Dave Scalley asked the applicant(s) if a survey had been done of the location of the new canopy. The applicant explained that a survey was not done however the location had been verified by the Town employees Scott Sonia and Greg Hogan per their application. Dave Scalley asked if papers had been passed on the property. The applicant(s) said no and that is why they were Applying for the various and not the potential new owners.
There were no further questions from the board at this time the chair asked if there was anyone in the audience that wished to speak in favor of the applicant(s) request for a variance.
Bill Vecchio asked about the new location of the poles and the applicant explained each corner.
Mike Hogan asked if the lighting was downward. The applicant stated yes it was in fact downward facing lighting. The chair asked if there was anyone in the audience that wished to speak against the applicant(s) request for a variance. T There was no response. The chair stopp3ed taking public comment and the board discussed the five criteria in order to grant a variance. Each criterion was discussed vigorously and voted on. At the end of the criteria discussion the chair asked if there were other comments from the board about this application. Since there were none Dave Scalley made a motion to approve the variance. Dianne Hogan seconded the motion. The chair asked if there was any discussion about the motion. There was not. The chair took the vote asking all in favor. All 4 board members present voted yes. The application for a variance by Donna and John Fosters DBA Fosters crossroads for was approved per there dimensions on their application.

The chair asked if there was any other business for the ZBA. Having no other business for the ZBA David Scalley made a motion to adjourn. John Trammel seconded the motion. Vote was taken by the chair and all were in favor of adorning the meeting.
