Meeting Minutes
November 13, 2018
“These minutes of the Town of Carroll Select Board have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions and corrections by the Select Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSA 91-A:2.”

The meeting was called to order at 5:30 p.m. by Chairman Scalley.
Pledge of Allegiance.
Chairman Scalley said the meeting was called to open bids for the land parcels that the town took by Tax Deed. It was stated there were two bids – one for each parcel. The envelopes were slit open by general consensus, but before the bid papers were removed, Selectman Mycko suggested putting an ad in the paper for another week. Selectman Moroney asked the reason and Selectman Mycko said because it was only in for one week which he felt was too short a period of time and because they only received one bid for each. It was noted that we had followed suggestions and direction from Town Counsel regarding placement and timing of the ad. During discussion, Chairman Scalley suggested Selectman Mycko’s reluctance was because he was the bidder. Mr. Scalley then asked Selectman Mycko if he made the statements because it was made known that it was Mr. Scalley. Selectman Mycko said no, it was not. Selectman Mycko made a Motion: Not to accept bids this week as the ad was only in the paper one week. Selectman Moroney seconded. Further discussion took place if no bids were received then they may decide to go to a realtor but then they’d have to increase the price to cover costs that would be incurred. The vote was taken and there were two ayes. Chairman Scalley abstained.
Selectman Moroney then made a Motion to: Run the ad for another week. Selectman Mycko seconded and it passed with two ayes and one nay.
Selectman Moroney said moving forward they should specify the number of weeks anything should be advertised.
As a Board member of Woodland Acres, Chairman Scalley chose to recuse himself from the Board to discuss Association fees with the Board.
When asked, Selectman Mycko said he was concerned when he found out there was only one bid and that the ad had been in the paper only one week. He spoke with Town Counsel, who said there is no law or regulation about the number of times or length of time an ad must be placed. But Selectman Mycko said he thought it didn’t look good that a Selectman was the bidder. Town Counsel said it could be advertised another week. His Board colleagues expressed their surprise that Selectman Mycko spoke to Counsel without their knowledge and he said Chairman Scalley did it all the time. Chairman Scalley said that was not the case as whenever he speaks with Legal, he asks them to send a summary by email to the Secretary who then forwards it to the Board. Selectman Moroney asked that Town Counsel be called and ask if there is an issue with advertising being only one week; and to also ask if there is an issue with accepting a bid with just one week of advertising in the paper. It was pointed out that the ad was placed in 11 newspapers – all those owned by the Salmon Press in various locations of the state from the North through the Lakes Region. It was also noted that the ad had been placed on the town website from the time it was approved by the Board, which was in October.
Selectman Moroney said it started out that ALL Select Board was in agreement with the process, including the ad, and now that has changed and asked Selectman Mycko again why it changed . She said it has been in the minutes numerous times as it had been discussed for several months. She said she felt if anyone was interested, they would have known it was coming.
Selectman Moroney asked the Secretary when speaking with Town Counsel, to also ask: 1, if we were jeopardizing ourselves by running only one week; 2, if it’s not an issue, can we revisit the bids received; and 3, if there is any legality going back on the bids received. She then asked that we hold off doing anything until after we hear from Attorney Mitchell.
Selectman Moroney asked that the item be on the agenda for the meeting Monday, November 19, 2018. It was also requested that we ask if there are any legalities regarding accepting them then; and to let Town Counsel know that they have not looked at them.
The Tax Warrant for $3,179,508.71, was presented for signing. Selectman Moroney made a Motion to: Approve and sign the Tax Warrant. Selectman Mycko seconded and the Motion passed unanimously.
There being no further discussion, Chairman Scalley made a Motion to adjourn the meeting. Selectman Moroney seconded and the Motion passed unanimously. Chairman Scalley declared the meeting ended at 6:10 p.m.
