Meeting Minutes
July 9, 2007
"These minutes of the Town of Carroll Select Board have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions and corrections by the Select Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSA 91-A:2."

The meeting was called to order at 7:02 PM.

The board announced the approval of bills and signing of checks.

Chairman Moroney moved to accept the minutes of the July 2, 2007 meeting as written. Selectman Vecchio seconded, and the motion was passed unanimously.

Stan Borkowski’s report is posted on the bulletin board.

There was no further news from the Carroll Economic Development Corp., and the secretary will ask one of the officers to attend a meeting of the Board of Selectmen.

The secretary reported that she had spoken with Mary Lavelle, and the Home Depot party will be held July 22 at the Recreation Center. They have agreed to the restrictions place by the board. John Trammell will check to make sure they have made arrangements for a detail officer to be on hand during the event.

Mr. Borkowski contacted John D’Urso about getting a building permit for the second trailer on his lot. According to Mr. Borkowski if the trailer is used only for storage and is put on a foundation, he can obtain a building permit without going to the Planning Board. Mr. D’Urso expressed his intention of coming to this meeting of the board, but evidently decided against it. Selectman Vecchio wondered if the Planning Board should be involved, and will speak to someone about this issue. These discussions have been going on since 2004, and everyone expressed the desire to finalize the issue of the two trailers on Mr. D’Urso’s property.

Discussion of action items listed on the minutes of July 2 was tabled until July 16.

Selectman Strasser suggested that we need to provide people with a Building Permit to post on their property so it’s obvious that any construction taking place has indeed obtained a permit. He said in the past some construction may have been done without having gone through the permit process. It was recommended an 8 ˝ x 11 red permit either laminated or protected with plastic be handed out after a permit is signed. The secretary will see about getting this done.

Bernie Waugh has prepared a letter to the AMC requesting additional information about their property. This is necessary to determine the exempt status of the Highland Center. Chairman Moroney moved to sign and send the letter. Selectman Strasser seconded and the motion was passed unanimously.

Bill Dowling presented a memo, which Chairman Moroney read, outlining the free training Leo Traverse gave to our highway department personnel. The training was in highway construction safety, and Mr. Traverse also donated approximately $2,300 worth of equipment to the town. Mr. Dowling had also prepared a letter of thanks to Mr. Traverse, which the selectmen signed.

Selectman Strasser presented several documents regarding unanticipated funds, accepting gifts, borrowing money, and selling property taken for taxes. From the 2005 town meeting he read an article passed that allows selectmen under RSA 31:95-b to accept and expend, for a specific purpose, unanticipated funds which become available. For gifts over $5,000 a public hearing shall be held on the action to be taken. He read another approved article from 1994 that allows selectmen under RSA 2l:95-e to accept gifts of personal property for public purpose. This acceptance shall not bind the town to expend public funds for the operation, maintenance, repair, or replacement of such personal property. For gifts valued over $500, a public hearing must be held prior to acceptance. At that same town meeting, an article was passed authorizing the selectmen under RSA 31:19 to accept on behalf of the town gifts held in trusts for a public purpose. This authorization shall continue in effect for one year from the date of the town meeting. Another 1994 article gives the selectmen under RSA 33:7 the authority to issue tax anticipation notes. The final 1994 article noted authorizes the selectmen under RSA 80:42 I and II to sell property taken for nonpayment of taxes.

Selectman Strasser then brought up the fact that it appears that the water department is operating at a $40,000-$41,000 deficit. He asked Billy Rines if he knew how far over we are on the Fieldstone Lane project, and when Mr. Rines said he wasn’t sure, asked for those numbers by Thursday or Friday.

Mr. Dowling reported that he’d been to a workshop at the Bethlehem landfill, and was told that they are enforcing HB 145 regarding video devices. Any load containing the banned items can be returned by the hauler and they can charge for the trip. This includes TVs, computers, video devices VHS tapes, etc. Selectman Strasser asked if there was a sign up in Bretton Woods about these devices, and if he’d called Paul Gamache regarding signs. Mr. Dowling said he has a meeting planned with someone at the hotel to start up their recycling program, and this will be discussed. Mr. Rines asked about CDs and VHS tapes (can be recycled), and it was decided to put something in the next town newsletter about this. The current charge for video equipment is $5 apiece, with no charge for CD’s or tapes.

Mr. Dowling said he’d gotten prices for a scale: Fairbanks Scale is $2,366 plus delivery for a scale with a stainless steel deck. New England Scales is $2,375 plus delivery for a scale with steel treated deck. After Mr. Dowling said he had the money in his budget, Chairman Moroney moved to approve the purchase. Selectman Strasser seconded the motion, and it was passed unanimously.

Heidi Boedecker, a Paquette Circle resident, came to speak about the house at 81 Paquette Circle. A foreclosure sale is being held on Tuesday, July 10, and she would like a representative from the town to attend. This house has been vandalized and is now a health hazard. There are broken windows, wide open doors, and trash everywhere. Before the refrigerator was removed everything in it was placed in the bathtub, and it’s still there. As a result animals have been in and out of the house. Ms. Boedecker is concerned that because of the approximate $250,000 mortgage on the house and its current condition, no one will buy it, and she wants the bank to be told they can’t leave the property as it is. She was unsuccessful in her attempts to reach the attorney for the bank, so doesn’t know if the bank is aware of the mess. The selectmen asked the secretary to call Evan Karpf, Health Officer, and ask that he be present at the auction tomorrow at 1 pm. Chairman Moroney said that if Ms. Boedecker could get the lienholder information, the town could contact the bank. If efforts by the Health Officer are unsuccessful in correcting the problems, the town could go to court if necessary.

At 7:40 PM, as there was no additional business, Chairman Moroney declared the meeting ended, and moved to go into executive session regarding personnel matters. This was seconded by Selectman Vecchio. The board was polled, and went into executive session.

At the close of executive session, Chairman Moroney made a motion to return to public session and seal the minutes from executive session; Selectman Vecchio seconded and the motion passed unanimously.
