CARROLL BOARD OF ADJUSTMENT
MEETING MINUTES

July 12, 2007


These minutes of the Town of Carroll Zoning Board of Adjustment have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions and corrections by the Zoning Board at its next meeting when the Board votes its final approval of the minutes.

Members of the Public present: Real J. Pelletier and Rev.Ernie Gault


The board went over the application for The Twin Mountain Baptist Church. There was no 3rd board member present so no vote will be made tonight. Joan apologized for not having a 3rd member show up.

Joan asked Ernie Gault who sent him to the ZBA. Ernie said Stan Borkowski directed him to the ZBA.

Joan asked about 1st question. The proposed use would not diminish surrounding property values because:
Leslie stated the question was more for the neighbors view and how it would affect their property, not the applicant. Real stated it was for the handicapped. Joan asked if the ramp would be a vision obstruction for anyone leaving the parking lot, for the church and for the Zermatt. Real stated it would not be a problem as the ramp would be low, and far enough from the road. Asked if the abutters would have a problem and how many there are. Real said there are only three, across the road are woods, next door on the left is a tree barrier, and on the right is the Zermatt.

Leslie said let’s make sure everything else is in order. Real mentioned the building does not currently meet setback requirements; it is a non conforming area. Joan referred to the ordinances - pg 17 Section 306-a, and added to the application that the setback in the back of the building is also non-conforming.

Joan asked why put the ramp in the front and not out back. Real said the grade drops below on the left side and on the right it is the septic tank and leach field.

Leslie asked what the distance is from the road to the front of the building. Real said it is 20.1 ft. and it should be 25ft. It should be 40 ft.

Joan asked if there is there an entrance in the back. Real yes, but again the grade is lower and also the entrance goes down a flight of stairs into the basement and there is no way to the first floor from the basement for handicapped. The only way to get to the upper level is with a stairway.

Joan said the hardship is that the ramp can’t go in another place. Real said it is the only entrance that can go to the 1st floor and all the handicap doors, bathrooms, and panic bars are located in the front.

Leslie asked if able people can get in without using the ramp. Real said yes. Joan asked if this was the safest way for handicapped to enter the building. Real said it is the only way and the safest.

Joan was satisfied, again no quorum as there are not 3 board members present. Will try and set up a date for another meeting. Will try and set it up ASAP so a notice can go in the paper about the public meeting on August 9, 2007.

Meeting adjourned at 7:40 pm.

Application accepted. The vote was approved and accepted by email in order to not penalize the applicant. The Public hearing is scheduled for August 9th 2007.
