Meeting Minutes
June 30, 2008

"These minutes of the Town of Carroll Select Board have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions and corrections by the Select Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSA 91-A:2."

The meeting was called to order at 7:00 PM.

Members of the public present: Roberta McGee, Bill Dowling, Billy Rines, Leslie Bergum, John Goodney, Monica Scales, Leo Scales

Pledge of Allegiance

The board announced the approval of bills and signing of checks.

Chairman Moroney moved to: accept the minutes of June 16, 2008, as written. Selectman Hancock seconded and the motion passed unanimously.

Stan Borkowski’s report was not received.

The following items were approved and signed:

Chairman Moroney then called upon Leo and Monica Scales. Mr. and Mrs. Scales have a right-of-way to their home on Route 3 North that runs along the boundary line of their neighbor, Michael Lynch. They have been having an ongoing dispute with Mr. Lynch about trees which he planted in 2002, and which were supposedly to have been kept trimmed. According to Mr. and Mrs. Scales this has not been the case, and the trees have grown substantially enough that vehicles are being scratched as they are being driven past the trees. Also, after a snowfall, the trees are bent over by the weight, and vehicles are able to pass through only with great difficulty, if at all. The Scales gave a history of this right-of-way, which had formerly been a town road to the old Roxmere Hotel. After the hotel had been closed for some time, the road was turned over to the Scales family. It is the Scales’ belief that the trees are in their right-of-way and that the set-back was not considered when they were planted. They noted that trees on their side of the right-of-way are part of the boundary. They added that Mr. Lynch has said he would trim the trees and then will put up a stockade fence, and this has them very concerned.

Mr. and Mrs. Scales have been working with an attorney regarding this matter. Chairman Moroney asked if there had been communication between their attorney and Mr. Lynch, which there has been after several attempts from their attorney. However, due to the cost of an attorney and to the fact that they believe the set-back is in violation, they have come to the town for help. Chairman Moroney suggested that we contact the Code Enforcement Officer, Stan Borkowski, and ask him to investigate this matter as soon as he can. When Mr. Borkowski reports back to the town, it will then be decided what, if anything, the town can legally do. Mr. and Mrs. Scales requested that Mr. Borkowski let them know when he will be making his visit as they wish to be present.

Next was Lori Hogan on behalf of the Recreation Committee. She presented the slate of employees, Derek Patterson returning as Director and his counselors with the various age groups they will be leading. Mrs. Hogan inquired about the Department getting a link or a drop-down on the Town web-site and this will be looked into. She also requested, to be sure the Department is following proper protocol, that a Town Hall Use Permit be signed for the use of the kitchen for two hours, one day a week during the period the program runs, as they have enlisted the help of several area chefs to come in and do some cooking with the children. The Selectmen signed the Permit.

Chairman Moroney then read a letter from Mrs. Tanya Lewis, the mother of a former full and part time counselor. Her daughter received a letter two days before she believed she was to start her job as a counselor, telling her that she was not going to be rehired for this season. Mrs. Lewis expressed disappointment and dismay for the way this was handled and for its very late timing. Mrs. Hogan explained part of the reason for the delay was that she had gotten hurt and apologized for the delay. She offered among the reasons for Ms. Lewis not being asked back was the Department’s desire to have older counselors (Ms. Lewis is 17) and to watch the budget carefully as enrollment is down this year. It was discovered that there was not currently a process by which staff are interviewed or hired or for handling any issues that may arise. The Board is working on a number of things including performance reviews and procedures for hiring staff; and ensuring that they know what is expected of them. Chairman Moroney expressed concern that not only should everything be absolutely clear, but that they remember that most of the staff are teenagers. Roberta McGee spoke on behalf of Ms. Lewis as she felt it important that the Selectmen know that she is a fine young lady, and the way her dismissal was handled, caused her great financial hardship. Chairman Moroney admonished the Board should work together on the programs and issues.

Chairman Moroney then read a letter from Roberta Daly regarding the two trailers on her property on Brook Road. Though she is to have them removed, it has become a matter of cost that she cannot afford until she sells the land. Chairman Moroney made a Motion to: send the letter to Town Counsel, Bernie Waugh, and ask him what we should do about it. Selectman Hancock seconded, and the Motion passed unanimously.

Chairman Moroney read a letter from NH DRED, Division of Parks and Recreation regarding an inspection of the Land and Water Conservation Funded project #33-00058, the Twin Mountain Snowmobile Trail. The inspection report was good except that the area lacked a sign. The mentioned sign was included for posting and the Selectmen asked that the Snowmobile Club be contacted to find out where this trail is and to have the sign put up.

John Goodney reported on any required FEMA classes and noted that things are moving forward slowly. It is believed that the Town is covered by what has already been done, but they are still checking.

Chairman Moroney will be working on a calendar for Department Head meetings.

John Burt was in to say he had received a letter from the Chief of Police about excess unregistered vehicles parked on his property on Route 3 North. He asked what the Selectmen know of this and was told that landowners must comply with the RSA that pertains to this. He apologized to the Town for this and for the condition of the property, but said he felt he had not been treated fairly, as others have been in the past. It has been his experience that people get a verbal notice or warning, and asked to respond before the formal approach from the Police. He explained that two of these vehicles were actually registered to him and the others were there only as favors to friends and family, but that he was taking care of it. He asked who the complaint was made by, and Chairman Moroney told him that John Gardiner had mentioned it to her and she felt she needed to follow up on it. She also explained that perhaps Chief Trammell, in his relative newness to the town, was not fully aware of how things have been handled in the past, and apologized that Mr. Burt felt he was not being treated as other citizens. (Mr. Burt also explained that he is trying to sell his property, but because of problems with the deed prior to his purchase, it is extremely difficult).

Roberts McGee thanked the Highway Crew for cutting the bamboo at the intersection of Ledoux Road and Parker Road. She said it visibility is very good now and greatly appreciated their acting so quickly.

Lori Hogan also thanked the Highway Crew for all the work they have done at the Rec Area – with the parking area and the bathrooms, to name a few examples. It was expressed that the area is now beautiful and hardly seems like the same place.

As there was no further business, Chairman Moroney declared the meeting ended at
8:30 p.m. and moved to go into Executive Session for town aid matters. The Board was polled and went into executive session.

At the close of executive session, Chairman Moroney made a motion to: return to public session and seal the minutes from executive session. Selectman Hancock seconded, and the motion passed unanimously.

There being no further discussion, Chairman Moroney made a motion to: adjourn the meeting. Selectman Hancock seconded, and the motion passed unanimously. Chairman Moroney declared the meeting ended at 9:00 p.m.
