“These minutes of the Town of Carroll Planning Board have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions,
deletions and corrections by the Planning Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSAS 91-A:2.”

Meeting called to order at 6:30 PM

Chairman Karpf declared there was a quorum and opened the Special Meeting regarding the conditions in the Dartmouth Brook Subdivision final decision. Dana Bisbee began by stating that there were two issues to deal with at tonight’s meeting. The first set of issues dealt with the three conditions of the Final Subdivision Decisions:

1. That the slopes for the driveways at Lots #139 and #140 shall not exceed 10%
2. That there shall be a hammerhead on Dartmouth Ridge Road for purposes of turnarounds for Lots #139 and #140
3. The applicant shall construct temporary turnarounds at two “dead end” locations; one in Phase I and a second in Phase II of the infrastructure development, both located along Darby Fields Way.

Condition #1 was accepted at the July 21st meeting. Chief Jeff Duncan brought up condition #2 also at that meeting, but he was soon toned out and it had to be tabled.

At this point Chairman Karpf read the Condition to address, “Within sixty days after the recording of the Dartmouth Brook Subdivision Plat, the Applicant shall apply to the Board for an amendment for the approval which will address, to the satisfaction of the Board, the need of a hammerhead turnaround on Dartmouth Ridge Road. (Planning Board regulation 4.17.6). Ernie Temple moved the motion. Charlie Cohn seconded, and the motion passed unanimously.

Dana Bisbee wanted to address the third condition requested by Chief Duncan. Evan Karpf said he would rather have read into the minutes that the regulations state “the applicant shall construct temporary turnarounds at all dead end locations.” This way, Evan stated they would not have to address this at every stage, but know that this regulation stands. Also the Chair asked that another regulation be read into the minutes that states “fire protection will be provided within 500 feet of all lots.” Dana Bisbee confirmed this for the record.

Mr. Bisbee asked if he could bring forth the second set of issues of the evening. He asked the Board for a copy of the Decision Document that would be signed by the Chair so that everyone would have a version of the final document and all could refer back to it at any time. Chairman Karpf agreed.

The one remaining issue Mr. Bisbee said has to do with the final version of the plat that has been signed. Because there now is a change by adding the hammerhead at the end of Lot #139, they are asking the board for relief from having to add the easement to the final plat (which is a requirement of the Planning Board). Because there are no changes to the lot lines they feel there is no need to have to add the easement. If required to add the easement, they would have to wait until the next meeting which is August 7th, before having the final plat ready to be recorded.

Evan Karpf read the response from Bernie Waugh, “if my understanding is correct that this is intended to represent a temporary turnaround (the theory being that this street will eventually be the access to the parcel lying to the northwest of the Dartmouth Brook parcel), then I see no inherent legal reason why this requirement (of putting the easement on the plat) could not legally be waived.” He also said that no one should construe this email as a recommendation that it should be waived, that this was a policy decision for the Board.

Chairmen Karpf asked if there were any questions and if everyone understood the waiver. No one had questions and all understood. Bonnie Moroney made a motion: to grant the waiver that the applicant does not have to put on the final plat the easement for the turnaround in the Dartmouth Brook Subdivision. Ernie Temple seconded, and the motion passed unanimously.

There being no further business, Ernie Temple made the motion to adjourn the meeting. Bonnie Moroney seconded and the motion passed unanimously.
