These minutes of the Town of Carroll Zoning Board of Adjustment have been recorded by its Secretary.
Though believed to be accurate and correct, they are subject to addition, deletions, and corrections by
the Board of Adjustment at a future meeting when the board votes its final approval of the minutes.
They are available prior to final approval to conform to the requirements of New Hampshire. RSA 91-A.2

Call Meeting to Order –Chairman Andy Smith calls the meeting to order at 6:30pm

Roll Call-5 members present so we have a quorum
Approval of Minutes
July 13, 2023
Chairman Andy Smith asks for motion to approve meeting minutes from July 13, 2023. Karen makes a motion to approve the minutes, Janet seconds……Andy asks, any discussion? Karen states ‘in new business section” we should add that the email was sent via “doodle”. Also, change the spelling of “ayi” to “aye”. Karen makes a motion to approve the minutes as adjusted. Andy states “all in favor??” 3 ayes from Anita, Karen and Janet, with Aaron abstaining because he was not present at that meeting. Minutes from July approved
New Business/Other Business
a. There was a question of whether there needed to be a Change of Use from 571 Rte 3 South, Lot 207-050-000-000. It was decided by the Planning Board the previous week, that this property did not need a Change of Use application with a site plan review. No further action is needed by the ZBA.
b. Aaron would like to bring up a question on the events that have happened in the past several months so in regards to reporting violations.
“What can WE do as part of the ZBA board and also as town residents, when we see something we don’t feel is right or feel is not following the rules of the Town of Carroll?”
Discussion ensues between the board on what are the boundaries are as a board member AND a resident in any type of reporting.
There is a feeling and a hope that going forward, the ZBA would like to work with both boards in a positive manner. Communication between boards is very important.
The ZBA decided that it would be best for informative purposes, to begin to meet every month regardless of anything being on the agenda. It would be best for communication, to stay in the loop and to discuss any concerns they may have.
Andy offers to take on the original question of concern…If we collectively as Land Use Officials, or individually as Land Use officials, are aware of something, can we bring it to the ZBA for discussion and say, “I don’t think this is following the guidelines that we voted on,” Do we as a board have standing to send this to the Select Board for enforcement and what’s the process for doing it, as a board. Rather than letting someone take the hit as an individual.
Review of Checklist
Variance checklist-Aaron has reviewed the printed documents as well as the digital documents. The legal comments can only be seen on the digital documents therefore, the red lined sentences are not the legal comments. Aaron decides to go through the legal comments verbally. The legal comments are from Laura Hertz, out of Bob Kerry’s firm (who was and may still be with Town Council).
The check lists are used as a guide/reference for consistency, efficiency and equitable treatment. Each check list is gone through as a group and suggested changes are discussed and agreed upon. As the board discussed changes in wording, Aaron makes any changes on the laptop electronically.
Aaron will go over the check lists and make sure all are revised/reformatted correctly per discussion. He will send to Corinne where she will forward to board members for review. These new check lists will be saved to the Land Use computer under the ZBA file.
Karen makes a motion to accept the 5 amended checklists to be updated and reviewed, Janet seconds the motion. Followed by 3 ayes.
Janet motions to adjourn, Anita seconds the motion…all in favor….3 ayes. The meeting is adjourned at 755pm.
