PUBLIC HEARING – POLE LICENSING

“These minutes of the Town of Carroll Select Board have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions and corrections by the Select Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSA 91-A:2.”

The meeting was called to order at 6:30 p.m. by Chairperson Scalley.

Chairperson Scalley opened the public hearing at 6:30 p.m.

Chairperson Scalley read the public notice:
“The Town of Carroll Select Board will hold a public hearing on Tuesday, November 16, 2021 at 6:30 p.m. at the Town of Carroll Town Hall, 92 School St., Carroll, NH, pursuant to the provisions of RSA 231:163 and 43:2, for the purpose of considering amending all existing pole licenses to include language regarding taxation pursuant to RSA 72:23 and acknowledging the licensee’s statutory obligation to move the licensed poles, conduit and equipment upon order of the Town.
The Board will also consider adopting a revised Pole and/or Conduit License form which will include language regarding taxation pursuant to RSA 72:23.
The hearing is being held to determine if it is in the best interests of the public good to amend the pole licenses so that they are consistent with the property taxation statutes (RSA 72:23).”
Chairperson Scalley asked if there are any questions. Selectperson Gauthier asked if the Board wanted to wait until Mr. Sansoucy arrived via Zoom to answer any questions the public may have and/or explain in depth, if necessary.

Chairperson Scalley gave a brief explanation, in Mr. Sansoucy’s absence.

Chairperson Scalley asked if there were any questions; there were none.

Chairperson Scalley asked the Board if they felt they could move forward or if they would like to wait for Mr. Sansoucy to join, so he could explain anything additional. The Board agreed that they were all fine to move forward.

Selectperson Gauthier motioned in the best interest of the public good to amend the pole licenses so they are consistent to property tax statutes RSA 72:23 by declaring all outstanding pole licenses issued by or under the authority of the Select Board of the Town of Carroll or its predecessors in office acting under the provisions of RSA 231:161(b), or its predecessor statutes are hereby changed to incorporate in each such pole license in effect as of November 17, 2021 and effective as of November 17, 2021, the following changes. The changes are reflected in the attached Town of Carroll, NH--Petition for License—Utility Poles/Conduit. Selectperson Mills seconded.

George Sansoucy joined the meeting via Zoom to answer any questions at 6:34 p.m.

Chairperson Scalley asked if there was any discussion.

Selectperson Gauthier re-read the motion to Mr. Sansoucy, and noted that it was seconded and that they are in the discussion phase. Mr. Sansoucy did not have any further discussion.

The Board continued. All in favor: Scalley-AYE, Gauthier-AYE, Mills-AYE. Motion passes unanimously.

The Board thanked Mr. Sansoucy.

Chairperson Scalley motioned to close the public hearing for the pole licensing. Selectperson Gauthier seconded. All in favor.

At 6:36 p.m. Chairperson Scalley announced that the public hearing for the pole licensing is closed.

Chairperson Scalley motioned to adjourn the public hearing for the pole licensing. Selectperson Gauthier seconded and the motion passed unanimously.

Chairperson Scalley declared the public hearing for pole licensing ended at 6:37 p.m.
