“These minutes of the Town of Carroll Planning Board have been recorded by its secretary. Though believed to be accurate and correct, they are subject to additions, deletions, and corrections by the Planning Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSA 91-A:2.”

Item #1: Call Meeting to Order
Meeting was called to order at 5:02pm

Item #4: Approval of Minutes – 3/5/26
Brian Mycko made a motion to accept and approve the minutes as written. Paula Murphy seconded the motion. Austin Alvarez abstained and all other members were in favor. Motion to approve the minutes for 3/5/26 was passed.
Item #5: Driveway vs. Roads
Fire Chief Jeff Duncan said that Billbarb Road was not built to spec as it should have been. There is a third lot that is building and wants access from the driveway but Town regulations say only 2 houses to a driveway or it needs to become a road. The original owners did not pull a Town driveway permits before they made their driveway so it has created a problem.
Building Inspector David Scalley said that back in 2023 the Planning Board approved Billbarb Extension which was not done according to the approved plan. Scott Sonia and David Scalley are working with the State on the driveway apron and specs. The State approved Billbarb Road and the Town approved Billbarb Extension. The State driveway permits only allows a certain number of lots to access through that driveway. Right now, we have too many lots accessing this entrance from Billbarb Road. Its kind of like Echo Lake. Billbarb Road may have to change a little bit.
The specifications on the State driveway permit says – This permit authorizes paved access to be used as a common residential drive. Any change in use increase or reconstruction requires a reapplication. The State only approved 2 driveways.
Brian Mycko said we will need a new State approval.
David Scalley explained the situation on a map to the Planning Board for them to understand.
Alex Foti asked if they could get another driveway permit through the State?
Fire Chief Jeff Duncan said that the State will not issue any more driveway permits off of 115 anymore.
Building Inspector pulled the recording from the registry #4668. It goes through lot 54.3. By subdividing the lot its created 3. If they put the extension in and the driveway off of the Billbarb extension then the driveway could serve the other 2 lots. It would serve 54.5 & 54.1 and 55 will come off of the extension.
Fire Chief Jeff Duncan shared his concern for the hammerhead not being built as it was supposed to be. They have also put a power line pole in for the site that is where the hammerhead was supposed to go.
Rena Vecchio asked if the road needed to be extended to service the different driveways?
Jeff Duncan said his issue is if one of the people decide they want to subdivide?
Building Inspector David Scalley said that in the future the Planning Board needs to be a little more careful when approving subdivisions.
Fire Chief Duncan reminded the Planning Board that nothing on the paper is flat.
Fire Chief Jeff Duncan also brought up where the hammerhead is supposed to go is its own subdivided lot. Hopefully everyone plays nice with their neighbors because now you have a person who specifically owns his lot which controls access to the other lots.
Building Inspector David Scalley explained the State approved Billbarb Road and that is in. It is not complete but it is in. The Town approved Billbarb extension with a hammerhead.
Rena Vecchio asked if the Planning Board approved something that went through someone else’s property?
Building Inspector said Dan Shaheen himself came in for it.
Brian Mycko said there will need to be specifications in the deed.
Fire Chief Duncan said it will need to discuss who maintains it and plows it.
Building Inspector David Scalley said the access was already in the deed.
Alex Foti said what he is hearing is for a potential solution is for Lot #54 to have its own driveway and then the other 2 lots can access off of the current driveway.
Brian Mycko said the driveway will need to be built to spec and he will have to go reapply with the State.
Discussion of the Planning Board decided it should be Dan Shaheen who puts the hammerhead in because it is on his property and was approved as part of his subdivision.
Fire Chief Jeff Duncan said with the plan they came up with creates a different lot that will not have access. The original design had Billbarb Road come all the way down to access the lots but because the area isn’t flat, they could not. Fire Chief Jeff Duncan asked how we encourage the builders to build what was submitted to us?
Brian Mycko said not to issue the CO’s.
Fire Chief Jeff Duncan said this all started because they want a 911 number. There are guidelines on how 911 numbers have to be instituted. If we call this a road and this Billbarb Extension then I can number the lots.
Building Inspector David Scalley said they need to go back to the State to get the approval for the additional lot. They approved 2 driveways for 2 lots and right now we have 3 lots.
Brian Mycko said it may change what they require for the cut to the road and the apron.
Fire Chief Jeff Duncan asks how we tell Mr. Shaheen he is responsible for this?
Building Inspector David Scalley said Mr. Shaheen did the subdivision and got the approval it should be him who does it.
Planning Board was in agreement that it belongs to Shaheen to build the hammerhead as he applied for it and was approved for it.
Building Inspector David Scalley said people are changing the location of the houses for the views. Similar to Bretton Woods & Dartmouth Ridge. Everyone put them up on the ledge for the view.
Fire Chief Jeff Duncan said he has been putting notes on the C.O’s that there is no guarantee the emergency vehicles can access the house. That’s a solution to a problem we shouldn’t have allowed to exist.
Alex Foti said to him the key is they are not doing what they said they would.
Building Inspector said if it doesn’t meet the specs and I stop them, what are they supposed to do?
Rena Vecchio & Brian Mycko said that was up to the owner to look into things before they buy the property or start work. Buyer beware.
Building Inspector David Scalley brought up Mark Vander-Heyden and Twin Mountain Plaza and how it wasn’t the intent so he had questioned it. Mark Vander-Heyden asked why we allowed it at Billbarb and won’t allow it for them. David Scalley said 2 wrongs do not make a right and then it was approved. If we don’t correct this now then we are allowing 3 houses on 1 driveway.
Brian Mycko said we need to correct it by making him put the hammerhead in and he has to update his permit with the State.
Building Inspector David Scalley asked the Planning Board a question. Someone doesn’t pull a permit or doesn’t get the permit in time so they pour their foundation, what do you do?
Rena Vecchio said tough luck. They started it knowing full well you have to have a permit.
Paula Murphy – said Ignorance of the law does not make it right.
Building Inspector David Scalley said in the past when we have had issues like this if they don’t have photos that can be inspected or a reputable foundation guy the Selectboard will meet and discuss what to put in their deed that says the Town was unable to inspect that part of the home and they are not liable. Now when they try to sell it and someone sees it on the deed, they may not buy it. So, you want them to tear it out?
Paula Murphy said they can fill it in.
Building Inspector David Scalley said himself and the Planning Board need to be a little more diligent before approving the plans. For this current situation Mr. Shaheen has to come back and label this as a road and then go to the State and get the additional access for Billbarb approved.
Fire Chief Jeff Duncan said the gentleman standing next to him is going to be absolutely impacted by this. This does not have a Town driveway permit they only received the State driveway permit.
Rena Vecchio asked for a letter to be sent to Mr. Shaheen that he needs to do what was approved at the Planning Board meeting when they approved his subdivision.
Scott Sonia to write a letter to Mr. Shaheen.
Letter to Mr. Warren needs to be sent explaining he has some unfished items to do as well.
Building Inspector David Scalley said another issue is they are going to need to cross some wetlands with this driveway. A new culvert will need to be designed to work correctly.
John Difeo (Paul Lennon’s builders) said that was in his scope of work.

Item #6: Bonnie Moroney – Assorted Items
Brief discussion on short term rentals. The Town sent out 289 letters in regards to short term rentals. 187 people responded. Of that 187 responses 106 said they don’t rent, 81 said they do rent and 102 did not respond. We need to figure out how to handle this. Lincoln has a regulation where they charge $100.00 for a yearly fee and they seem to be doing well with it. They are going to hire a company to handle this because it has become a job in itself. Bonnie Moroney said she was willing to get together with Chief Duncan and try to figure out how to handle it.
Alex Foti reviewed the list of rentals that was sent out. Alex Foti said just from his quick overview of the list there were some outdated names that have sold their properties.
Steffanie Apostle to update list to current owners as some have sold
Alex Foti suggested adding the short-term rental form on the Town website to help make it a little easier.

Alex Foti asked if the property managers to register for their clients?
Steffanie Apostle said that would work
Fire Chief Jeff Duncan said 82-85% of calls last year for first responders were not for Carroll residents. We had no information who owned the home and who to contact.
Jeff Warren asked if the State was helping and if there were State regulations to register.
Bonnie Moroney explained that they have not helped the Towns out and the Towns are kind of on their own.
Paula Murphy asked about room and meal tax
Fire Chief Jeff Duncan said they get about $100.00 per person
Alex Foti said it was pooled at the state level and then distributed to the Towns by number of full-time residents.
Brian Mycko said its based-on number of residents not rentals. There are other Towns in the State with no hotels or rentals and they get room & meal tax money also.
David Scalley asked about renting his house for 6 months and 1 day and would he have to pay Room and Meals tax?
Alex Foti – Not if the rental is longer than 6 months and 1 day.
David Scalley asked if I rent 3 months out of the winter I have to pay?
Alex Foti – Yes. Any rental longer than 6 months and 1 day is exempt but it has to be a single rental for the whole duration.
Don Jones said he looked it up and it is mandatory in New Hampshire since 2021. It is a $50.00 annual fee with fines up to $1,000.00. Why did we not do this?
Alex Foti said this was just our starting point to get something going with short term rentals. We can add to the next round of warrant articles.

Meeting briefly turned to a Selectboard meeting and Selectboard Chair Brian Mycko and Selectboard Rep. Bonnie Moroney voted to unseal some legal records
