No prior minutes to approve as this was a special Planning Board meeting to discuss a warrant article in regards to landfills, Incinerators, recycling centers and transfer stations.
Item #5: Review of Proposed Warrant Article
Selectboard Rep. Brian Mycko made the audience aware that all 3 Selectboard members were present but Jules Marquis and Bonnie Moroney were there as residents and this was not a Selectboard meeting.
Alex Foti thanked everyone in the audience for attending and reminded everyone they are all welcome to come and join any of the monthly public Planning Board meetings.
Alex Foti reminded everyone in the audience that if they had not signed in yet to please do so.
Alex Foti explained that the purpose of the Planning Board meeting and Public Hearing was for an amendment to the Zoning Ordinance to describe what transfer stations, recycling stations, incinerators & landfills will be allowed in Town and what will not be allowed in Town. Over the last several meetings there has been a lot of input from the public.
Alex Foti read the proposed amendment to the audience.
Section 1: Landfills and Incinerators
Are you in favor of the adoption of Amendment No. 1 as proposed by the Planning Board for the Town of Carroll Zoning Ordinance as follows:
No person, persons, partnerships, or corporation shall transport garbage or rubbish in an unsanitary manner or without the same being thoroughly protected from exposure or leakage; nor dump or leave the same in any place other than provided for said purposes. Further, no solid waste disposal facility, site or expansion of any existing solid waste facility or landfills shall be permitted except a facility operated by the Town for the purpose of providing a solid waste disposal facility for solid waste generated in the Town. Such a Town owned facility shall be subject to Planning Board Site Plan Review and meet the Town’s Site Plan Regulations. The acreage to be used shall be on the Site Plan. This prohibition shall include, but not be limited to, any private solid waste disposal facility or site, sanitary landfill or incinerator. The requirements and prohibitions in Section 1 or Section 2 shall not apply to existing private facilities in operation at the time of adoption. Any proposed changes to existing private facilities submitted after adoption of Section 1 or Section 2 shall be subject to the requirements and prohibitions herein.
Section 2: Recycling Centers and Transfer Stations
Are you in favor of the adoption of Amendment No. 2 as proposed by the Planning Board for the Town of Carroll Zoning Ordinance as follows:
Recycling centers and/or Transfer Stations shall be subject to Site Plan Review regulations, provided such facilities are owned and operated by the Town for the transfer and/or recycling of solid waste generated in the Town and provided further that the recycling center or transfer station is owned and operated by the Town or by a Regional Solid Waste District whose ownership or operation thereof is governed by an agreement entered into pursuant to RSA 149-M:24. The requirements and prohibitions in Section 1 & Section 2 shall not apply to existing private facilities in operation at the time of adoption. Any proposed changes to existing private facilities submitted after adoption of Section 1 or Section 2 shall be subject to the requirements and prohibitions herein.
Brian Mycko made a motion to accept the warrant article and Don Jones seconded the motion. All were in favor and nobody abstained. Motion to accept the warrant article passed.
Alex Foti opened the meeting up to the Public Hearing
Sharon Monahan asked about things that are already privately owned. Who owns the current transfer facility and Recycling Center? Are their any other places like that in Town doing something that we do not know about?
Alex Foti said there are currently (2) in the Town.
Brian Mycko said one was the Bretton Woods transfer station and there is one in Town for the Town residents.
Sharon Monahan asked if someone came to the Town in the future would it be something like what Bethlehem has? Is that a possibility that could happen here?
Paula Murphy said if this passes no.
David Monahan said that he was a writer and he has looked at the warrant article but would like a quick summary of what the Warrant Article said.
Brian Mycko said it would mean there would be no transfer stations other than the one owned & operated by the Town & BWPOA (Bretton Woods Property Owners Association) would be allowed.
Mike Hogan said if the Town is going to look at their Ordinances they need to look really hard at what is allowed and what is not allowed. The whole Town needs to get together and decide what they want or do not want. Such as a junkyard, the ordinance says it allowed but do we really want it? The Town should hold a meeting like this so everyone can get together and discuss what they do and do not want in Town.
Alex Foti said the Town would be starting their Zoning Ordinance overhaul this year. Alex Foti also told everyone in the room they are welcome to join the meeting.
Joe Wesolowski told the Planning Board he goes down Trudeau Road and you can smell the trash. I don’t want that to happen to this Town. Its almost like being next to Chernobyl. We have a beautiful river that goes through this Town. We don’t need more trash going towards Bethlehem. The whole area is dealing with this and I really like where it says it is for Town trash only.
Cathy Fulkerson said she wanted to piggy back off of that last statement from Joe. Do either one of these statement address odors? I see exposure and leakage but not odor? That is for more solid or liquid but does that include odor?
Brian Mycko said that the Town already has an Ordinance in regards to odors.
Ann Marie McParland said she agreed with the last statements. Ann Marie McParland asked how we as a Town can control the trucks coming through?
Alex Foti said that was out of their control as that was a State Road and not a Town road.
Jules Marquis got up and addressed all of the people in the room. Jules Marquis had called Casella to talk to them because he was hearing conflicting stories and information on what Casella wanted to do so he reached out for clarity.
Jules Marquis spoke to a Mark who was the one designing what they wanted. Jules Marquis asked him what they planned on doing. Jules Marquis said the Town currently had (2) transfer stations and Casella was looking to do the same thing. Casella would handle trash, recycling and construction waste. The pick-up trucks that take the dumpsters don’t want to drive too far if they don’t have to because it costs a lot of money and they need more drivers. What they are looking to do is come here and allow the trucks to dump there. This would be for either 100 tons or 200 tons of trash a day. It would amount to 100 tons would be 10 tractor trailers full and 200 tons would be 20 tractor trailers. For the loading trucks it would be 30 for 100 tons and 60 for 200 tons. They would be coming from surrounding areas within a specific radius.
There were some comments from the audience about it being a lot of trucks and trash per day.
Jules Marquis said they were already driving through Town, that would not change. Jules Marquis has his dumpsters at his campground picked up. If you think about it, 20 tractor trailers from the lights to my campground that would hold 40 trucks. In the summer they line up by his campground and its about 35 trucks. Its nothing as far as traffic goes. It would be about 5 minutes of traffic, its not a whole lot. As far as how the place is run, anything that they dump there would have to be cleaned. It gets dumped in the morning but needs to be picked up at night. Everything will be off the floors and in the trailers. Nothing is going to stay for more than a day before its gone. Its basically the same transfer stations that we have now except it is bigger, does more and has a scale.
Kathleen Soule asked about Casella wanting to use the railroad.
Jules Marquis said that did not come up in conversation.
Alex Foti reminded everyone that they were not reviewing the application. This was all speculation & heresy. We are here to discuss a Warrant Article to prevent additional transfer stations and recycling facilities in our Town.
Question from the audience to clarify if we pass the Ordinance, this would not be allowed.
Alex Foti said that was correct. Alex Foti also clarified that if the application is dropped off before this gets voted on and passes, we will have to go by the current ordinances.
Joan Nicosia asked about where the verbiage came from?
Alex Foti said that we had modeled it from the Bethlehem Zoning Ordinance and adjusted it for our Town.
Jules Marquis said that since he had spoken to Casella last for the project plans Casella has informed Jules they will no longer be coming to the Town. Jules Marquis said the Town has to be careful what we allow and don’t allow in Town. If the Town starts blocking things that could create jobs it could be a problem. Casella would have added 3-4 jobs for people in the Town. If the Town wants to be a normal Town and have stores and thigs like that you have to start with the job market. Nobody is going to want to come in here and start a business with 100 jobs, there is not enough working people in the Town. If you can add 3-4 jobs at a time that will work and get you more people here year-round and not just seasonal. You have to be careful with what you want to block and how much you want to block. If you want to change from the Airbnb’s and seasonal rentals we need more jobs.
Barbara Monahan said she hears Jules and understands the job market but her concern was it would be in a gravel pit. Anything could seep through a gravel pit and into the water table. What would it be in 5 years?
Alex Foti said those were great comments for when we have an application but the discussion tonight was the Warrant Article.
Nathaniel Lesch-Huie from Parker Road who has been running the Facebook page said he has been doing his best to make all the information public. Nathaniel Lesch-Huie said to Jules Marquis that there was some conflict between Jules Marquis and a relative of his who works for Casella.
Nathaniel Lesch-Huie said he thought it was strange that Jules Marquis was pushing for Casella to come to Town. In terms of jobs, we live here because we like it. I drive over an hour to work each way and I come home to a quiet peaceful place and I like it that way. We don’t need more jobs. If you are supporting them, just make it clear why you are doing it because with your position with the Town its confusing and misleading. Have full disclosure about your position.
Jules Marquis said he didn’t care if Casella came to the Town or not. That is up to everyone in the room. Jules Marquis said he was concerned about the future of the Town.
Nathaniel Lesch-Huie said everyone here knows how to make a living.
Jules Marquis said its not just here, its what the Town is made up of.
Alex Foti brought the audience back to the Warrant Article and asked that all comments be related to the Warrant Article.
Bill Briggeman had a question in the second sentence of section 1. Its very clear no solid waste disposal and he was wondering why there wasn’t a similar clear statement in Section 2.
Alex Foti said because section 1 was for landfills and section 2 was for recycling & transfer stations.
Brian Mycko said it is made clear that whatever it is has to be owned and operated by the Town.
Bill Briggeman asked why it was not said more clearly.
Brian Mycko said there are people that make a lot more money than them who decide these things and verbiage.
Chuck Jellison got up to speak. He said that he has lived here for a couple years and he can remember when Mr.
Sanborn sold a piece of property over on Trudeau Road. 30 Years later we have Mount hock a loggie over there. That is what we don’t need here. This is in its embryo stage and needs to be nipped in the butt.
Tom Monahan got up and said he has been in this Town longer than anyone except the Garneau’s. 75-80 years ago, the Dubois family from Jefferson NH was interested in purchasing the land right at the junction of 3 & 302 to build what is now known in the area as Santa’s Village. The Selectmen at the time didn’t want the traffic and the Town has survived. We have thrived and have got along without Santa’s Village and we better try to get along with Casella. Casella is a publicly traded New York stock exchange multimillion-dollar company. I wouldn’t trust the CEO of Casella any further than I would some other people. They may say it’s a transfer station but you can bet your sweet buck that will become a dump no matter what they say.
Kathleen Soule said her and her husband live on Parker Road right next to where they are proposing the transfer station. I think Casella looks for these little Towns that do not have Ordinances in place. Kathleen Soule said she thanked the Town very much for bringing this to the front and letting the town decide what they want.
Nick Bolcon who lives over by Parker Road asked what happens if the Town passes this Warrant Article and the State decides to override it?
Alex Foti said the State can always override the Towns.
Nick Bolcon asked if there was anything we could do about that?
Brian Mycko said there were a lot of Bills at the State Level to take a lot of the Zoning away from Towns and there is nothing we can do about it. The State overrules.
Paula Murphy said we need to fight for local control.
Brian Mycko said until those are approved at the State House, we still have local zoning. They could get turned down at the State level.
Betsy Warren a resident said she had reached out to the State Rep’s. The Representatives said it was important to tell them how the Town feels and what their thoughts are.
Nathaniel Lesch-Huie said he tries very hard to keep his Facebook updated with all the bills and items.
Debra Cornish is a homeowner on Parker Road. Debra Cornish wanted to touch back on how the Warrant Article read to her. “Recycling centers and transfer stations shall be subject to Site Plan review regulations provided that they are owned and operated by the Town
“If I had a recycling center and it is not owned by the Town, does that mean I m not subject to regulations?”
Alex Foti said she wouldn’t even be able to come to the Board because it would not be allowed.
Debra Cornish thinks the language should be a little tighter. Debra Cornish worries about big companies that are able to hire very smart lawyers.
Alex Foti said that he could see Debra Cornish’s point. An easy way to strengthen the language would be to say “Recycling center and/or transfer station shall be subject to Site Plan review regulations. Such facilities must be owned or operated by the Town.
Rena Vecchio said the only thing is if we change this now, we will need to hold another public hearing. Our idea is to put this in and then we can alter it when we do Town voting. Right now, time is of the essence.
Brian Mycko said to put this through now as is because the Town is getting ready to redo their Zoning Ordinances and we can change it then.
Brian Mycko said that Casella tried to do something in Bethlehem and with the ordinance they were not allowed to.
Alex Foti said although he agrees it could be clearer, he believes the language is quite strong and will prevent them from coming in to Town.
Brian Mycko said our lawyer read it and approved it so if he thinks he has grounds to fight it, he knows better than us what he can fight.
Barbara Monahan suggested changing the wording from the start.
Don Jones said that would be at the expense of having this done next month. We could have something in place by the end of May if we keep it as is. If we change it now it gives them a larger window to submit before we can vote.
Alex Foti said this was a solid starting point that we can approve on as we redo the ordinances.
Mike Hogan said his understanding is the Town needs a Site Plan for the centers, nowhere does it say a private party can. If we push this out to July to change the wording and they come in June we are screwed.
Nick Bolcon asked if he was reading it correct and that the Town transfer station is only for the Town residents? Anything new needs to be owned and operated by the town.
Alex Foti said yes.
Alex Foti asked if there were any more questions?
Cathy Fulkerson said it was hard for regular people to read and understand this. Cathy Fulkerson said she had faith the Town had done their due diligence.
Paula Murphy said there are a lot of hoops they would need to jump through and studies they need to have done.
Brian Mycko said they will need full design plans also. There is a bit of info that needs to be provided when you submit an application.
Mr. Monahan asked if there was anything that the Town needed from the residents to get this through?
Alex Foti said procedurally tonight is the hearing to see what everyone has to say. When the comments are complete the Board will vote on it. If it passes then it will go to vote.
Brian Mycko said the Town vote is May 26th. Everybody has to come out and vote to approve this. Votes will be counted that night.
Mike Hogan said his understanding was if it wasn’t in the ordinance it wasn’t allowed.
Alex Foti said that was changed
There was a member in the audience that asked the Board to go around and state their names so she could put a face with the name.

Bernie Kelley from Parker Road asked if anyone in the room had lived near a dump because you don’t want to. He lived near a dump in Nashua and we do not want that in this Town. It will be a rude awakening.
Nathaniel Lesch-Huie said he drives by dump trucks every day and you smell them from miles away. They smell, they leave trash, they are not good.
Public Hearing was closed.
Alex Foti was really grateful and appreciative of everyone coming to express their thoughts. Alex Foti reminded everyone the Town was working on the Zoning Ordinances and they were all welcome to come and talk about it. All the members are volunteers and they can’t think of every scenario so it will be open to the public for their input also. The more heads we have working together, the better the results will be.
Brian Mycko made a motion to approve the warrant article as written and Rena Vecchio seconded it. All were in favor and nobody abstained. Motion to approve the warrant article passed.
Voting will be May 26th.
