Meeting Minutes
June 5, 2006




“These minutes of the Town of Carroll Board of Selectmen have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions and corrections by the Board of Selectmen at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSAS 91-A:2.”


Board members present: William Wright, Allen Strasser, Bonnie Moroney

The meeting was called to order at 7:10 PM.

Members of the public present: Roberta McGee, Tom Gately, Carmine Fabrizio, Ann Fabrizio, Doug Bews, John Burt, Evan Karpf, Jeff Duncan, Butch Garneau, Owen Garneau, Nancy Mitiguy

The board began with the approval of bills and signing of checks.

Selectman Moroney made a motion to approve the minutes from 05/22/2006. The motion was seconded by Selectman Strasser and passed unanimously.

A Supplementary Water Warrant for $80.00 was signed by the selectmen.

The letter from the NH Department of Labor was discussed. The Safety Summary Report for January 1, 2006 was not complete and they have asked to have it redone. This must be submitted within 15 days. Also the fact that the Safety Manual was not finished was mentioned.

Evan Karpf asked if there were RSA’s that mandated all the safety items we’ve taken care of and Selectman Strasser that we are not governed by federal agencies like OSHA, but the NH Department of Labor enforces similar standards. Dr. Karpf asked if the town was doing things to ensure that we don’t get into another situation like this one. He said there are seminars and workshops available for selectmen and other board members, and many of them are free. Selectman Strasser stated there is money in the budget for training this year, and we’re doing things like the trench box workshop that’s scheduled for June 26. Selectman Moroney has attended a number of workshops for selectmen, trying to learn as much as possible as soon as possible.

The issue of funding for a Capital Improvement Program was discussed. Claire Gritzer was consulted about taking money from capital reserve, and it appears any money this year will have to come from somewhere in the budget. Selectman Strasser moved that we table this funding until August, when we’ll know the ramifications of the safety inspection. Chairman Wright seconded the motion, and it passed unanimously.

At the last meeting there was discussion about declaring Old Town Road an Emergency Lane, but no date was set for a public hearing. Selectman Strasser moved that we hold a public hearing on the third Monday in July, the 17th. Chairman Wright seconded the motion, and it passed unanimously.

Chairman Wright informed the group that a meeting with the AMC has been scheduled for June 27th. He said we had asked Town Counsel about the possibility of having the three men who went to Concord for the House and Senate hearings attend this meeting as observers only. Attorney Waugh advised that this initial meeting with the AMC be between just the selectmen, AMC representatives, and legal counsel. Selectman Strasser said if some agreement can be made on the tax issues, there would be a public hearing held before anything was made official.

The board was informed that we’ve received no applications for the office cleaning position, but that the newspaper ad will run again this week.

The secretary informed the selectmen that we have addressed the computer backup issue in the town offices. Frank Caruso has set up programs to burn CD backups and they will be done at least weekly, with one copy each time being stored offsite. As far as purchasing a server, the need is not critical until ProVal, the software for tax assessments is ready to go.

The following documents were approved and signed by the selectmen.

Yield tax certifications for Lapoint, Timber Resource Group, and Bretton Woods Ski Area (2)
Request to transfer funds for the new ambulance from the Ambulance Special Revenue Account to the General Fund
Title transfer of the old ambulance which is being traded
Town Hall Use Permits for the Baptist Church (2) and W. Dowling
Invoice for NH Division of Forests and Lands for mutual aid during an April forest fire

A letter to the Selectmen from Yvonne Meisner was read. She enclosed a photo and registered a complaint about the property of John Wolf on Lennon Road. There is litter around the house, bees and flies due to the cans and bottles, and a well that could be a hazard for small children. She has asked the selectmen to do something about the problem. Selectman Moroney will get us the phone number for the state liason for the Board of Health, to see if they can do anything.

A letter to the Selectmen from Phyllis Powell was read. She said in the course of doing repairs on her house, they noticed that it was originally a single family home, and they have returned it to that status, and improved the appearance of her property. Chairman Wright suggested we write a letter to Ms. Powell thanking her for making her property more attractive.

A discussion of what the town plans to do about heating oil for next winter was next on the agenda. The Energy Alliance (Irving Oil) had sent out a mailing, and their current price is $2.46 per gallon. Stiles Fuel over the phone said they will not take lock in orders until late June or July. They allow commercial accounts to pay over wholesale price until November or December and then lock in for fuel until March. An important issue for most people is maintenance on the boilers, and Irving was not willing to give us a service contract last year. A number of names were suggested for comparison of pricing and service: C.N. Brown, Rhymes, and Precision Fuel. We’ll contact each of these businesses.

The list of Due Diligence Items requested for later this week by Orr & Reno was discussed. Most of the items pertain to the hotel, restaurant and motor lodge. Some items like a Certificate of Occupancy for the Mt. Washington Hotel, probably do not exist. It was suggested that Stan Borkowski may have some of the information they are looking for. Ms. McDuffy will be here on Thursday June 8.

Nancy Mitiguy asked if a street light has been approved for Twin View Drive, and no one was aware of that happening. Ms. Mitiguy said she was here to oppose any street light for this road, that there were better places to spend the town’s tax money. She’s been touring various subdivisions and most do not have street lights. If individuals need lights, they usually put them on their own house. Problems on Twin View Drive have diminished since more houses were built. Selectman Strasser said he’d like a “dark sky” program, where lights have shields so they shine down only, not all over. Ms. Mitiguy would not like to see lights put in at individual requests without a plan for overall lighting in town.

Dr. Karpf brought up the Riverstone Subdivision in Bethlehem that will be accessed through Twin Mountain. They are likely going to ask the Town of Carroll to allow them to hook up the 34 lots to our town water, and he wanted to ask the selectmen to think about some issues prior to approving such request. How much water do we have? Do we know? How much would we have in a time of drought? Chairman Wright commented that Billy Rines says it would be a perfect setup for looping the waterline rather than have the Rivers Edge II waterline dead-ended. He also said he thought the state could tell us based on what we use, how much water we might need in case of drought. Tom Gately asked why we did not require Jerry Warren to put in a loop; can’t we require that. Dr. Karpf said we have a right to require these things, and they are trying to keep these things in mind. Chairman Wright said he felt the sale of water in an area like this would allow the town to expand water lines in places like Rte. 302 West, Lennon Road, and Cherry Mountain Road. Jeff Duncan wondered how we were going to maintain water lines on a private road. Others expressed doubts about not having enough water during a drought.

Dr. Karpf suggested we might want to re-visit the lighting ordinance that was proposed three years ago. Mr. Bews suggested it was turned down because of the difficulty in enforcement. It would have to be done on a voluntary basis, but new people in town could be given a package of information dealing with things like lighting.

Butch Garneau came to the Board to ask if he and his son were going to get the mowing jobs they had last year. He had been told by Mr. Rines he’d have to wait until July, because of cash flow concerns. He was concerned because someone else mowed the cemetery before the holiday weekend. Chairman Wright moved the hire the Garneaus to do the same mowing they did last year. Selectman Moroney seconded, and the motion was passed unanimously. Mr. Garneau also said that jobs like the fire station dirt work were things he could do, and he’d like the town to keep him in mind.

At 8:20 PM, as there was no additional business, Chairman Wright declared the meeting ended and moved to go into executive session regarding personnel matters. This was seconded by Selectman Moroney. The board was polled, and went into executive session

At the close of executive session, Chairman Wright made a motion to return to public session and seal the minutes from executive session; Selectman Moroney seconded and the motion passed unanimously.
