Meeting Minutes

February 5, 2015




“These minutes of the Town of Carroll Planning Board have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions,
deletions and corrections by the Planning Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSAS 90-A: 2.

The meeting opened with the Chair asking if everyone had a chance to look over the minutes of January 8, 2015. The secretary asked the board to please table the minutes as she had not been able to make the changes to the Subdivision Regulations that they had made at the that meeting.
Bonnie Moroney made a motion to: table the minutes of January 8th until the next meeting.
Karen Saffian seconded and the motion passed unanimously.

Evan Karpf asked the board if they had voted on the minutes of October 2, 2014. The secretary told him that she had not had a chance to look at the DVD that he had left of that meeting but would do so for the March meeting. (The secretary was on vacation for the October 2nd meeting and wanted to look at the DVD before she made any changes to minutes that were not hers.)

The Chair told the board that town Counsel had been notified of the questions the PLBD had on whether they should be involved in the Cog Railway sign changes and the route they should take. Town Counsel emailed the board that this belonged to the ZBA only. The Planning Board had taken a vote to hold a joint meeting with the ZBA in February. The lawyer told the board to rescind their vote.

Bonnie Moroney made a motion to: rescind the vote of the Planning Board on January 8, 2015 to hold a joint meeting with the ZBA in February for the Cog Railway sign. Richard Krapf seconded the motion and the motion passed unanimously.


Chairperson Foster said that board member Richard Krapf has been working on an Ordinance for Cell Towers for the past several months. The company he has been dealing with, CMS had given Richard a copy of the contract and the board had sent it to Town Counsel. Counsel then sent it back to the town. Richard sent the requests to the company CMS. The response to the requested changes are attached to the minutes in the office.

The basics of the contract are:
• CMS is giving 5 hours for free to the town to work on the Cell Tower Ordinance
• They in turn want to be the “third party reviewers” for all cell tower applicants for three years
• They work in our behalf, they have no vested interest

The board wants to look further into:
• References on the company (attached to emails)
• What the fees will be for the applicant for the review
• What percentage of fee would they keep

All agreed that the town needs a Cell Tower Ordinance. It protects the town.

Richard Krapf made a motion to: send all the information of CMS and its contract, the requests of our lawyers and CMS’s response to the Select Board. Karen Saffian seconded and the motion passed unanimously.

Donna Foster said she has been in contact with Stan Borkowski, Building Inspector/Code Enforcer, over a dog kennel/training center on Route 115 called Dark Dynasty K-9. Neighbors have concerns over:
• No fencing
• No posting for “attack” dog training
• This is a rental property, owners are not on hand

Stan has gone to the property. Renters are willing to communicate with us to get information on what is needed.

So far this is what is known:
• There can be 15 to 25 dogs at any given time that reside in the home. They do not believe in cages.
• There are, maybe, two breeding’s a year.
• Training goes on there for dogs from all over.
• All dogs have run of the farm
• What type of insurance do they have for this type of business

Town Counsel will be sent the information we have about the permitted uses in a Rural Area. Questions on this are about kennels, boarding, raining, litters and sanitation. No one is trying to shut the business down. The board is just trying to cover its bases. Mention was to ask Stan Borkowski to do written reports on visits to places so that all the information was in one place and could be documented. Also there is an issue with no sign permit. They were not aware of the need for a permit for the sign. If they keep the sign up, a permit is needed. Otherwise, the sign is to come down.


Evan Karpf made a motion to: rescind the acceptance of the Site Plan Review Application for the Mount Washington Cog Railway at the January 8, 2015 meeting. Bonnie Moroney seconded and the motion passed unanimously.(per our lawyers)

Evan Karpf made a motion to: refund the Mount Washington Cog Railway all charges for the Site Plan Review Application. Karen Saffian seconded and the motion passed unanimously.

Bonnie Moroney made a motion to: adjourn. Evan Karpf seconded and the motion passed unanimously. The meeting ended at 7:50.
