Meeting Minutes
July 3, 2006



Board members present: Allen Strasser, Bonnie Moroney

The meeting was called to order at 7:00 PM.

Members of the public present: Roberta McGee, Eleanor Brauns, Jackie Garneau, Dan Garneau, Nancy Mitiguy, Doug Bews, Jeff Duncan

The board began with the approval of bills and signing of checks.

Selectman Strasser made a motion to approve the minutes from 06/26/2006. The motion was seconded by Selectman Moroney and passed unanimously.

Jackie Garneau came before the board to ask some questions relating to the investigation prior to Louise Staples’ trial. She wanted to know if the selectmen had done their own investigation and were personally aware of $118,000 being missing from town funds. Selectmen Strasser explained that the selectmen were not and could not be involved in the investigation. He explained that a forensic auditor would look at town records, the insurance company would look at those and the records from the AG, and determine an amount to be reimbursed to the town. Ms. Garneau stated she was appalled that the selectman did not do their own investigation. Selectman Strasser stated that because Ms. Staples was an elected official the AG’s office was in charge of the investigation. Roberta McGee asked what records our auditor was using, and was told she is using forensic tests to compare things like revenue from one period to another. Ms. Garneau stated she’d like to make a complaint against Chief Gardiner. She was upset about the way he acted on the day the verdict came in. He went up to the dump and was telling everyone about it before the family was even back in town, and she heard stories about telling people her son and cousins possibly doing harm to the town hall. She felt he acted in an unprofessional manner, and she didn’t know what avenue to take. Selectman Strasser suggested she write a letter with specifics and the selectmen would look into it. Mrs. McGee noted that prior to the state resting its case a plea agreement was offered and turned down, as Ms. Staples wanted to clear her name. She also stated that the forensic auditor that testified for the defense had never testified before and felt strongly enough about this case to support the defense. Nancy Mitiguy asked if Chief Gardiner had submitted his resignation yet and was told no. She also asked if the selectmen were willing to write a letter to the judge saying that the town would not seek restitution. Selectman Strasser said they could not do that, by law the town would receive restitution.

Stan Borkowski’s report was noted as posted on the bulletin board. Selectman Strasser pointed out Item #19 as being important for the town. It states that ISO has certified Mr. Borkowski to the new state building code, which will drop the ISO rating by 1.0 to the good. If we, by warrant, article adopt the new state code, it will drop the rating another 1.0.

Selectman Strasser suggested contacting Chief Gardiner about the progress on the safety handbook.

The public hearing on declaring Mountain View Lane and Emergency Lane has been put off until August. We have not heard from the DOT regarding perhaps upgrading the road rather than replacing the bridge on Old Town Road.

Jeff Duncan came before the board to discuss the Elworthy subdivision off Rte. 3. He asked the board to urge Stan Borkowski to revoke the building permits for this subdivision. He said they are supposed to put in roads and water prior to beginning construction, and they’ve not done that. In addition there has been no state driveway permit issued to date. One house is under construction, and they are preparing foundations for the other two. The selectmen said they’d contact Mr. Borkowski regarding this order.

Mr. Duncan asked what Bill Dowling’s responsibility is as far as Fire Department training. He stated that their training is according to Fire Department standards, and the town needs training related to the Department of Safety. Selectman Strasser said in naming Mr. Dowling Director of Safety, the idea was not to have him responsible for Mr. Duncan’s training.

Doug Bews asked about the June 27 meeting held at the AMC. Selectman Strasser said they really couldn’t say much because of the court case involving the PILOT Agreement. Both sides agreed that no decisions would be made without a public hearing. Mr. Bews repeated what he had brought up at earlier meetings, that the AMC’s exempt status prohibits them from serving alcohol, and he would bring the pertinent IRS code documents to the selectmen.

At 7:50 PM, as there was no additional business, Selectman Strasser declared the meeting ended and moved to go into executive session regarding personnel matters and town aid. This was seconded by Selectman Moroney. The board was polled, and went into executive session.

At the close of executive session, Chairman Wright (came in just after session started) made a motion to return to public session and seal the minutes from executive session; Selectman Moroney seconded and the motion passed unanimously.
