TOWN OF CARROLL ZONING BOARD OF ADJUSTMENT


MINUTES July 14th 2016
Members present were: Chairman-Paul Bussiere, Dianne Hogan, Rob Gauthier and John Trammel, David Scalley
Members of the public present were: William and Laurel Thompson
The Public Meeting was called to order at 7:00 PM by Chairman Bussiere.
The pledge of allegiance was recited. Chairman Bussiere introduced the Applicants to the ZBA and asked the applicants to present their case for a variance of zoning regulation section 303.5 setback requirements for RU zoning Town of Carroll.
Mr. Thompson went thru their application. Mr. Thompson seeks relief from the setback requirements for RU Town of Carroll zoning ordinance. Mr. Thompson explained that the physical restrictions did create a hardship to place the garage in a different location. The septic is located to the side of the home and the eastern side of the property has their driveway. The chair asked the board if there were any more questions for the applicant(s). There were none so the Chair asked if there was anyone that wanted to speak for or against the proposed variance application. There was no one present for or against the applicant. At this time the Chair asked for discussion from the board as the applicant’s burden of proving each of the 5 criteria required to grant a variance. The board discussed each requirement and felt that the applicant had satisfied the requirements. The board mentions to the applicant that they need apply for a building permit. At this time Mr. Trammel made a motion to approve the granting of a variance to the applicant to place the garage per the provided plan. Dianne Hogan seconded the motion. The chair asked for all in favor of granting the variance. The vote was unanimous to approve granting the variance. The board informed the applicant(s) that they can now proceed with the building permit process for the garage.
The chair asked if there was any other business for the ZBA. The chair informed the Board that the certified letter sent to Mr. D’Urso was not picked up and was returned to the ZBA. The board discussed what authority they had to enforce Town of Carroll Ordinance 407 (property maintenance and appearance standards). Mr. Trammel informed the board that the Health Officer made a visit to 726 Lennon Road for a complaint of trash about the property and the neighbor’s property. Mr. Trammel informed the ZBA that as the Chief of Police he visited the site and informed the owner that he must clean up his property. The board suggested sending the request of enforce the standards to the select board.
All Board members voted to approve the motion.
The chair asked if there was any other business for the ZBA.
There was no more business and Mr. Scalley a made a motion to adjourn. Dianne Hogan seconded the motion. The chair took the vote and all board members were in favor of the motion.

Meeting adjourned at 7:55 PM
