Meeting Minutes
February 4, 2008
"These minutes of the Town of Carroll Select Board have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions and corrections by the Select Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSA 91-A:2."

The meeting was called to order at 7:00 PM.

Pledge of Allegiance

The board announced the approval of bills and signing of checks.

Chairman Moroney moved to accept the minutes of January 28, 2008, as written. Selectman Vecchio seconded and the motion passed unanimously.

Stan Borkowski’s report has been posted on the bulletin board.

The Oath of Office certificate for Roberta McGee as Cemetery Trustee from May 7, 2007, was presented for signing by the selectmen. It was an oversight that it had not been signed at the time Ms. McGee was sworn in. At the same time, the selectmen were asked to visit the Town Clerk to fill out the certificates for their swearing in when they took office. The swearing in had been done for all, but the paperwork had never been done. They all did this before meeting’s end, and the paperwork is in place with the Town Clerk.

The secretary reported there is a water leak in the basement ladies’ bathroom that comes from rotted decking on one of the old unused entrances to the town hall. Mr. Rines said he plans to replace the decking.

Chairman Moroney read a letter from Charles Adams of Celebration Associates. In it he said there are significant inconsistencies in the revised agreement to accept land for a Bretton Woods fire station. Mr. Adams suggested meeting with the selectmen personally to discuss this rather than trading emails. It was decided that if Town Counsel could be available February 28th an hour earlier than he’d intended to come for the Municipal Law Update meeting, that would be a good time to meet. The secretary will contact Atty. Waugh and Mr. Adams with the suggestion.

A certification of Yield Tax for Matthew Steele was approved and signed.

Ron Cote of NH DRA would like to meet with the selectmen and employees involved with the assessing process. This is in conjunction with the cyclical assessment review being done for 2007. It was suggested that the meeting be scheduled for February 12th at 4 pm. Selectman Vecchio said she would be unable to attend.

Karen Carew will be here on Thursday to help with the Management Discussion Letter for the 2006 audit. Chairman Moroney suggested that if necessary, she will try to meet with her at that time.

The revised Hoyle Tanner contract was reviewed, and because we have received a approval of plans from the state DOT, Selectman Strasser moved to approve and sign. Chairman Moroney seconded the motion and it was passed unanimously.

It was announced that the date has been set for Atty. Waugh to meet with the selectmen, Planning Board, and ZBA to review the latest Municipal Law Updates. He will be here February 28th at 7 pm.

John Trammell will look through his files for documents written by John Gardiner referencing the deterioration of the old police station. Selectman Vecchio said she’s had questions about why all of a sudden there was a problem with the station, and she’d like to see some of the old correspondence.

The secretary reported that she’d spoken to the state about the Trail Crossing Agreement that was never executed properly in 2004 when the town waterline was installed to Jerry Warren’s subdivision on Mountain View Lane. They are going to have the AG’s office review it again, then send a new document for signature by current selectmen. We will have Atty. Waugh review it at that time.

Chairman Moroney read two letters from property owners in Bretton Woods regarding the proposed District Overlay Ordinance. One was from Nancy Hardaway and the other from Stephen & Susan Kraabel. Both expressed concern over the lack of height restrictions in the ordinance. Evan Karpf began by stating that he is in favor of the village concept, then stated that he is a member of the Planning Board, was involved in writing the ordinance, and in the end had voted against it at the Public Hearing. He said they were under pressure to finish it in time for the hearing, and feels it was done too quickly. He said since then he’s done some research and villages in Sugarbush, Stowe, and Bartlett all have height limits. He said abutters who have concerns about views have said they could live with a 4 story limit, and in his opinion there should be parameters in place. He said the ordinance has no height restriction as long as there is not a public safety issue, and that the plans are to the satisfaction of the board. He doesn’t think that a denial that “isn’t to the satisfaction of the board” would not stand up in court if appealed. Selectman Strasser said the view shed issue is dealt with in the Bretton Woods Master plan signed years ago. Selectman Vecchio pointed out that Dr. Karpf had said nothing during most of the meeting, and then voted against it and stated why after the vote. She expressed concern about a board member talking against something after the vote, saying it creates distrust in the board. She said he should have done more homework before the vote. Dr. Karpf said if the ordinance is voted down, he would be more than willing to have a special meeting in a month so we don’t hold up the developer for a year. Selectman Strasser said that the existing Crawford Ridge units violate the Bretton Woods agreement now because of a lack of screening. He also said the current view shed provision reads that views cannot be blocked from the hotel porch. Dr. Karpf said he wants to remain objective and if he gets new information about this ordinance, may change his mind.

Bill Dowling reported that he would be asking to make a change to two of the warrant articles at the Deliberative Session. On Article 17 for the 2008 tipping of bulky waste, etc., he will add aluminum cans to the list. He said he wants to buy cans from the Regional School district kids. He will offer them half the market value and will involve classes of students rather than individuals. He thought it would be a good fund raiser for the students, and recycling income for the town. When asked, Mr. Dowling said the cans will have to be delivered to the transfer station. The other article he will amend is Article 16 for maintenance of the old landfill. He would like to change the amount from $10,000 to $16,000. If the money is not spent, it will not be taken out of capital reserve.

Mac McQueeney informed the selectmen that on election day, March 11th, Ben Jellison would be acting as moderator pro tem.

At 7:45 PM, as there was no additional business, Chairman Moroney declared the meeting ended, and moved to go into executive session regarding legal matters, town aid and personnel matters. This was seconded by Selectman Vecchio. The board was polled, and went into executive session.

At the close of executive session, Chairman Moroney made a motion to return to public session and seal the minutes from executive session; Selectman Vecchio seconded and the motion passed unanimously.
