WARRANT
TOWN OF CARROLL
2009

To the inhabitants of the Town of Carroll of the County of Coos, and the State of New Hampshire, qualified to vote in town affairs:

FIRST SESSION

You are hereby notified to meet for the First (Deliberative) Session of the annual meeting, at the Town Hall, Twin Mountain in said Town of Carroll on February 3, 2009 at 7:00 PM. The First (Deliberative) Session will consist of explanation, discussion, and debate of the following warrant articles, and will afford those voters who are present the opportunity to propose, debate and adopt amendments to each warrant article, except those articles whose wording is prescribed by the state law.

SECOND SESSION

You are also notified for the Second Session of the annual town meeting, to elect town officers by official ballot and to vote by official ballot on the warrant articles as they may have been amended at the First Session. The Second Session is to be held at the Town Hall, Twin Mountain on Tuesday, the 10th day of March 2009 at 8:00AM in the forenoon (the polls are to open at 8:00AM and may not close prior to 6:00PM) to act on the following,

Article 1. Election of Town Officers


Article 2. T o see if the Town will vote to raise and appropriate the sum of Two Million One Hundred Eighty Thousand Dollars ($2,180,000) for the construction and original equipping of a new Police Station Building and to authorize the issuance of not more than Two Million One Hundred Eighty Thousand Dollars ($2,180,000) on bonds or note in accordance with the provision of the Municipal Finance Act (RSA 33) and to authorize the Town of Carroll Select Board to issue and negotiate such bonds or note and to determine the rate of interest thereon. This requires a Three-Fifth (3/5) ballot vote. Tax impact is $.68 per thousand. Recommended by the Selectmen and the Budget Committee.


Article 3. To raise and appropriate as an operating budget, not including appropriations by special warrant articles and other appropriations voted separately, the amounts set forth on the budget posted with the warrant or as amended by vote of the First Session, for the purpose set forth therein, totaling sum of One Million Nine Hundred Sixty Thousand Forty One Dollars ($1,960,041). Recommended by the Budget Committee


Should this article be defeated; the operating budget shall be One Million Nine Hundred Sixty Seven Thousand Eight Hundred Eighty One Dollars ($1,967,881) which is the same as last year, with certain adjustments by previous action of the Town or by law or the governing body may hold one special town meeting, in accordance with RSA 40:13, X AND XVI, to take up the issue of a revised operating budget only.


Article 4. To see if the Town of Carroll will vote to raise and appropriate the sum of $1,200.00 (Twelve Hundred Dollars) to contribute to the regional Household Hazardous Waste Collection Program. The Program will provide residents access to a Household Hazardous Waste collection of household generated hazardous waste such as oil based paints, paint thinners, solvents, pesticides, gasoline and household cleaners. Recommended by the Selectmen and by the Budget Committee. $.003 impact on tax rate


Article 5. To see if the Town will vote to raise and appropriate the sum of $4,000.00 (Four Thousand Dollars) for maintenance of the old landfill, including actual physical maintenance, engineering and overseer expenses; and further to authorize the withdrawal of that entire sum from the Landfill Closure Capital Reserve Fund created in 1994, with no amount to be raised from new taxation. Recommended by the Selectmen and by the Budget Committee.


Article 6. To see if the Town will vote to raise and appropriate the sum of $14,000.00 (Fourteen Thousand Dollars) for the 2009 trucking and disposal of:
bulky waste
construction debris
freon
propane tanks
electronics
florescent light bulbs
antifreeze

The appropriation will be from March 2009 through March 2010. This is to be raised from the Recycling Special Revenue Fund established at the 2001 Town Meeting for this purpose. No amount to be raised from taxation. Recommended by the Selectmen and by the Budget Committee.


Article 7. To see if the Town will vote to raise and appropriate the sum of $21,000.00 (Twenty-one Thousand Dollars) for the purpose of surveying and designing an area at the Town’s Transfer Station on New Straw Road, to be sited southwest of the existing compactor box and embankment, into a wooded area approximately 200 feet, to be used in the future for temporary storage and removal using a tractor-trailer; and further, as necessitated by the anticipated closure of the Bethlehem landfill; and further, to authorize the withdrawal of that entire sum from the Special Revenue Fund with no money from new taxation. Recommended by the Selectmen and by the Budget Committee.


Article 8. To see if the Town will vote to raise and appropriate the sum of $7,110.00 (Seven Thousand One Hundred Ten Dollars) for the purpose of ground-water monitoring at the old landfill including $2,100.00 (Two Thousand One Hundred Dollars) for engineering, sampling, and reports, and $5,010.00 (Five Thousand Ten Dollars) for laboratory analysis of the samples; and further, to authorize the withdrawal of the entire sum from the Landfill Closure Capital Reserve Fund (established in 1994) with no amount to be raised from new taxation. Recommended by the Selectmen and by the Budget Committee.


Article 9. To see if the Town will vote to raise and appropriate the sum of Thirty Four Thousand Five Hundred Dollars ($34,500) for the purchase of a new police cruiser and associated equipment, and of this total, to authorize the withdrawal of Twenty Five Thousand Five Hundred Dollars ($25,500) from the Police Cruiser Capital Reserve Fund, created in 1981, with the balance of Nine Thousand Dollars ($9,000) to come from taxation. Recommended by the Selectmen and by the Budget Committee. $.02 impact on tax rate


Article 10. To see if the Town will vote to raise and appropriate the sum of Six Thousand Dollars ($6,000) for the purchase of two handheld portable 2-way radios for the Police Department. Recommended by the Selectmen and by the Budget Committee. $.02 impact on tax rate


Article 11. To see if the Town will vote to raise and appropriate the sum of Four Thousand Seven Hundred Dollars ($4,700) for the purchase of one vehicle 2-way radio for the Police Department. Recommended by the Selectmen and by the Budget Committee. $.01 impact on tax rate


Article 12. To see if the Town will vote to raise and appropriate the sum of Thirty Seven Thousand Dollars ($37,000) for the purchase of one outdoor UL2200 emergency generator, installation, service plan and outside cement pad, to be installed at the Town of Carroll Town Hall. Money to be raised by taxation. Recommended by the Selectmen and by the Budget Committee. $.10 impact on tax rate


Article 13. To see if the Town will vote to raise and appropriate the sum of Sixty Nine Thousand Two Hundred Dollars ($69,200) for the purpose of purchasing a dump truck with plow, sander, and two-way radio communication for the Highway Department, and further, to authorize the withdrawal of that entire sum from the Highway Capital Reserve Fund created in 1980, with no amount to be raised from new taxation. Recommended by the Selectmen and by the Budget Committee.


Article 14. To see if the Town will vote to raise and appropriate Twenty Thousand Three Hundred Seventy Two Dollars ($20,372) for the purpose of being expended, together with funds appropriated in the Operating Budgets of 2008 and 2009 to reclaim and resurface New Straw Road. and further, to authorize the withdrawal of Twenty Thousand Three Hundred Seventy Two Dollars ($20,372) from the Road Improvements Capital Reserve Fund established in 1980. Recommended by the Selectmen and by the Budget Committee.


Article 15. To see if the Town will vote to raise and appropriate Twenty Three Thousand Dollars ($23,000) for the purpose of building a Salt and Sand Containment with overhead cover for the Highway Department; and to withdraw that entire sum from the New Land and Buildings Capital Reserve Fund. No money will be raised from new taxation. Recommended by the Selectmen and by the Budget Committee.


Article 16. To see if the Town will vote to raise and appropriate Fifteen Thousand Dollars ($15,000) to be placed in the Municipal Truck Capital Reserve Fund. Recommended by the Selectmen and by the Budget Committee. $.04 impact on tax rate


Article 17. To see if the Town will vote to raise and appropriate Fifteen Thousand Dollars ($15,000) to be placed in the Police Cruiser Capital Reserve Fund. Recommended by the Selectmen and by the Budget Committee. $.04 impact on tax rate


Article 18. To see if the Town will vote to raise and appropriate Ten Thousand Dollars ($10,000) to be placed in the Highway Equipment Capital Reserve Fund. Recommended by the Selectmen and by the Budget Committee. $.03 impact on tax rate


Article 19. To see if the Town will vote to raise and appropriate Thirty Thousand Dollars ($30,000) to be placed in the Land and Buildings Capital Reserve Fund. Recommended by the Selectmen and by the Budget Committee. $.08 impact on tax rate


Article 20. To see if the Town will vote to raise and appropriate Two Thousand Dollars ($2,000) to be placed in the Computer Technology Capital Reserve Fund. Recommended by the Selectmen and by the Budget Committee. $.01 impact on tax rate


Article 21. To see if the Town will vote to raise and appropriate Two Thousand Dollars ($2,000) to be placed in the Library Improvement Capital Reserve Fund. Recommended by the Selectmen and by the Budget Committee. $.01 impact on tax rate


Article 22. To see if the Town will vote to raise and appropriate Ten Thousand Dollars ($10,000) to be placed in the Landfill Closure Capital Reserve Fund. Recommended by the Selectmen and by the Budget Committee. $.03 impact on tax rate


Article 23. To see if the Town will vote to raise and appropriate Ten Thousand Dollars ($10,000) to be placed in the Road Improvements Capital Reserve Fund. Recommended by the Selectmen and by the Budget Committee. $.03 impact on tax rate


Article 24. To see if the Town will vote to raise and appropriate the sum of Two Thousand Dollars ($2,000) to the Coalition Communities in Portsmouth, New Hampshire consisting of 34 towns to represent the Town of Carroll in a solution to our educational funding crisis by opposing the establishment of donor towns and keeping the statewide property tax so that it can be used locally to fund our own education assessment from the White Mountain Regional School District. With our participation, the Coalition has already saved the Town well over $200,000 per year for several years. Recommended by the Selectmen and by the Budget Committee. $.01 impact on tax rate


Article 25. To see if the Town will vote to establish a revolving fund under the provisions of RSA 31:95-h for the purpose of providing public safety service contracted details and to deposit ninety five percent (95%) of the income from fees and charges for these services into this fund: and to further authorize the Town of Carroll Select Board to expend monies from such fund for the purpose of providing such public safety contracted details. Recommended by the Selectmen.


Article 26. To see if the Town will vote to establish a Recreation Revolving Fund pursuant to RSA 35-B:2 II. The money received from fees and charged for recreation activities, service and use of facilities shall be allowed to accumulate from year to year, and shall not be considered to be part of the Town’s general fund unreserved fund balance. The Town Treasurer shall have custody of all monies in the fund, and shall pay out the same only upon order of the recreation committee treasurer. These funds may be expended only for recreation purposes as stated in RSA 35-B. And further, to appropriate the sum of Five Thousand, Seven Hundred Dollars ($5,700) to be placed into the Recreation Revolving Fund being created under this article, with the total amount to be withdrawn from the Recreation Special Revenue Fund established at the 2004 Town Meeting, and no amount to be raised by taxation. Recommended by the Selectmen and by the Budget Committee.


Article 27. To see if the Town will vote to raise and appropriate up to Thirty Thousand Dollars ($30,000) for the 2009 Twin Mountain Recreation programs including the winter ski program, town parties, and the summer recreation program. The appropriation will be from March 2009 through March 2010. This appropriation will be raised from the Recreation Special Revenue Fund established at the 2004 Town Meeting for this purpose. No money will be raised from new taxation. This article shall take effect only if Article 26, concerning the Recreation Revolving Fund, fails to be adopted. Recommended by the Selectmen and by the Budget Committee.


Article 28. To see if the Town will vote to accept land donated to the Town of Carroll under the Agreement for Option to Accept Land Donation made effective June 19, 2008, between the Town of Carroll and the Bretton Woods Land Co., LLC, for the purpose of a Fire Station and/or Police Station and shall constitute approximately 2.8 acres of land adjacent to Route 302. Bretton Woods shall donate the property upon the Town issuing a “Notice to Exercise Option” to Bretton Woods. The Notice to Exercise Option shall consist of a letter signed by a majority of the Carroll Board of Selectmen, citing the Town’s Authorization to accept the donation by way of an affirmative vote of the Legislative body. Recommended by the Selectmen and by the Budget Committee.


Article 29. To see if the Town will vote to authorize the Board of Selectmen to sell certain town-owned property shown on Tax Map 405 Lot 15, approximately 0.210 acres. Located on Old Cherry Mountain Road. Said property will be sold by the Town upon such reasonable terms and conditions as may be negotiated and agreed by the Selectmen and to authorize the Selectmen to execute all documents and take all other actions reasonable and necessary to carry out the purpose of this vote. Recommended by the Selectmen.


Article 30. To see if the Town will vote to authorize the Board of Selectmen to negotiate a transfer of land parcels, one parcel being owned by Curtis and Beckie Pike of 147 New Straw Road, being approximately +/- 1.8 backland acres, the other parcel being owned by the Town of Carroll, approximately +/- 1.8 acres fronting on New Straw Road.

This is being brought forward pursuant to a report from the New Hampshire Department of Environmental Services which states the “manganese concentration exceed Ambient Groundwater Quality Standards in groundwater in monitor wells MW-5 and MW-6, both close to the down gradient boundary of the groundwater management zone,” from the Town of Carroll’s old landfill. The monitoring wells are within twenty (20) feet of the Pikes’ backland property, which land falls off abruptly, leading a reasonable person to assume a high probability of contamination of the Pikes’ backland property, this being the parcel of land the Pikes wish to transfer to the Town of Carroll in return for the Town owned parcel of the same acreage fronting on New Straw Road

If the Town votes to adopt this transfer of land article, this plan must also be approved by the New Hampshire Department of Environmental Services. The Pikes will bear all costs related to this transfer of land parcels. By Petition -- Not recommended by the Selectmen.
Article 31. To see if the Town will vote to grant a driveway access easement on the Land Donation Property in Bretton Woods known as Map 419 Lot 18 to abutting property known as Map 419 Lot 16 if the Warrant Article for the Land Donation Property is passed. This easement will be granted on the day of transfer of the Land Donation Property. This would give Steve Messina access to a portion of his property which currently does not have a driveway access. Mr. Messina would then have the opportunity to beautify his property located on National Scenic Byway 66, Route 302 East which currently has an existing dilapidated house that is an eyesore in our town. Any and all liabilities within the easement will be the sole responsibility of the owner of Map 419 Lot 16. This easement would be no cost to the taxpayers of Carroll but may increase tax revenue to the Town once improvements of the property are completed. By Petition – Not recommended by the Selectmen.


Article 32. To see if the Town will vote to authorize the Selectmen to transfer the sum of Six Thousand Five Hundred Dollars ($6,500) from the Planning Revenue Fund established in 2006, to the General Fund for the purpose for which it was intended, to fund the Planning Board, Zoning Board of Appeals, and Zoning Enforcement Officer duties. Recommended by the Selectmen.


Article 33. To see if the Town will vote to authorize the Carroll Conservation Commission to retain the unexpended portion of its 2009 appropriations as authorized by RSA 36-A:5, said funds to be placed in a conservation fund account held by the municipal Treasurer (RSA41:29). Recommended by the Selectmen and by the Budget Committee.


Article 34. To see if the Town will vote to discontinue the Bridge Capital Reserve Fund. Recommended by the Selectmen and by the Budget Committee


Article 35. To see if the Town of Carroll will vote to raise and appropriate the sum of Nine Hundred Four Dollars ($904) as the Town's contribution to the Northern Human Services - White Mountain Mental Health and Common Ground, a non-profit mental health and development service center. Recommended by the Selectmen and by the Budget Committee. $.002 impact on tax rate


Article 36. To raise and appropriate the sum of Two Thousand Dollars ($2,000) to donate to the Tyler Blain House, Lancaster, NH, one of the only homeless shelters in northern NH. Recommended by the Selectmen and by the Budget Committee . $.01 impact on tax rate


Article 37. To see if the Town of Carroll will vote to raise and appropriate the sum of Six Hundred Dollars ($600) payable to Littleton Regional Hospital, to help offset the cost of charity care and community benefit programs that Littleton Hospital provides. Recommended by the Selectmen and by the Budget Committee. $.001 impact on tax rate
Article 38. To see if the Town will vote to raise and appropriate the sum of One Thousand One Hundred Thirty Three Dollars ($1,133) and turn over such monies to the Weeks Medical Center - Home Health & Hospice Services. The monies are used to provide home health care services to the residents of Carroll. Recommended by the Selectmen and by the Budget Committee. $.002 impact on tax rate


Article 39. To see if the Town will vote to raise and appropriate the sum of Seven Hundred Fifty Dollars ($750) for the support of preventative and primary health care services of Ammonoosuc Community Health Services, Inc. for the residents of Carroll. Recommended by the Selectmen and by the Budget Committee. $.001 impact on tax rate


Article 40. To see if the Town will vote to raise and appropriate the sum of One Thousand Seven Hundred Ninety Seven Dollars ($1,797) payable to North Country Home Health & Hospice Agency, Inc for the support of the home health care, supportive care, medical hospice and community health programs and services of North Country Home Health & Hospice Agency, Inc. and Hospice of the Littleton Area for the residents of Carroll. Recommended by the Selectmen and by the Budget Committee. $.005 impact on tax rate


Article 41. To see if the Town will vote to raise and appropriate Three Hundred Forty Six Dollars ($346) for the American Red Cross. Recommended by the Selectmen and by the Budget Committee. $.001 impact on tax rate


Article 42. To see if the Town will vote to raise and appropriate the sum of One Thousand Six Hundred Fifty Dollars ($1,650) for the Caleb Interfaith Volunteer Caregivers that serves the needs of elderly people in the community. Recommended by the Selectmen and by the Budget Committee. $.004 impact on tax rate


Article 43. To see if the Town will vote to raise and appropriate the sum of Five Hundred Dollars ($500) for Court Appointed Special Advocates (CASA) of NH for recruiting, training and supervising volunteers who advocate in NH’s courts for the best interests of abused and neglected children. Recommended by the Selectmen and by the Budget Committee. $.001 impact on tax rate


Article 44. To see if the Town will vote to raise and appropriate the sum of Eight Hundred Five Dollars ($805) for Tri County Community Action Program in support of their services for the community. Recommended by the Selectmen and by the Budget Committee. $.002 impact on tax rate
