Meeting Minutes
May 18, 2009

"These minutes of the Town of Carroll Select Board have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions and corrections by the Select Board at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSA 91-A:2."

Board members present: Bonnie Moroney, Ken Mills. Chris Hancock was excused.

The meeting was called to order at 7:09 PM, by Selectman Moroney in Chairman Hancock’s absence.

Members of the public present: Joan Karpf, Roberta McGee, Dan Tucker, Edith Tucker, Allen Strasser, Tom Gately, Carmine Fabrizio, Ann Fabrizio, Mike Gooden, Bill Smalley, Tadd Bailey, Jeff Duncan, Jeremy Oleson, John Trammell, Kelly Trammell, Nancy Mitiguy

Pledge of Allegiance

The board announced the approval of bills and signing of checks.

Selectman Moroney made a Motion to: Accept the minutes for May 11, 2009 as written. Selectman Mills seconded and the Motion was passed unanimously.

Stan Borkowski’s report was received and posted.

The following items were approved and signed:

Yield Tax Abatement – US Government/Timber Resource Group
Property Tax Abatements – Gamache, Hoffman, Abbott, Eden, Maguire, Twin Mountain
Family Ltd.
Notice of Intent to Cut – Temple
Signature Card for Laconia Bank – Selectmen Moroney and Mills signed. It will be held
for Chairman Hancock’s signature and then given to the Treasurer for the Bank

Joan Karpf asked that the name for Twin Mountain Family Ltd. be checked on as it should be Birchwood Commons.

The Procedure Policy for RSA 91-A, the Right to Know was brought forth. It had been brought up at a prior meeting and some changes had been requested. The Secretary advised that she had worked on this with, and it had been approved by, Town Counsel. Selectman Moroney read the Policy with the changes (copy attached). Selectman Moroney made a Motion that: the Select Board accept this Policy. Selectman Mills seconded and it passed unanimously.

In Other Business:

There were two bids for Highway equipment not used anymore and advertised for sale by bid. These were to be turned over to the Road Agent.

Selectman Moroney read a letter with a budget analysis (attached) that she stated she was unsure of where it came from. It was an answer to tax comparisons and personal commentary brought to the previous meeting by Allen Strasser. Selectman Moroney read another letter (attached) in response to Mr. Strasser’s material from Police Chief, John Trammell.

Selectman Mills stated he had just returned from vacation and was happy to be back home in Twin Mountain. He thanked all who had had done so much work, Chief Trammell, Mr. Strasser, and expressed his appreciation for the engagement and participation on everyone’s part. He feels it assists the Board as there are only three of them and a lot of RSA’s, etc. to cover and just wanted to say thank you. Mr. Strasser requested copies of the material read tonight and also asked that his letter be posted on the board beside the Chief’s letter. He said there isn’t just one answer to this question, there’s a lot more data and he will be bringing more to this Board and to the Budget Committee. He stated he felt comparing tax rates with towns assessed at different times which he feels the towns used in tonight’s material were, didn’t really give an exact comparison.

Mr. Strasser went on to request a copy of the Procedure Policy for 91-A just adopted and asked if this means he can see the material he requested without any of the “Hippa stuff” brought in. Selectman Moroney told him absolutely not and said it states right on it that the material in question would have to be redacted. Selectman Moroney proceeded to re-read #5 of the Policy. Mr. Strasser continued to question why he cannot have this information, looking for case law, and referred to his letter of weeks prior in which he requested specific details. Selectman Moroney stated it is RSA 91-A:5 IV, and Mr. Strasser told her she was overlooking the previous part that said “records of any payment to any employee …….. be made available without alteration for public inspection.” Selectman Moroney stated we must black out Social Security number, personal sick leave, personal health insurance information as that comes under Hippa and personal information. She further explained that the Board had just met with their lawyer who gave the list of information not to be given out and had gone over RSA 91-A with them. Mr. Strasser again insisted that he could look at the back-up paperwork with the payroll checks that the Selectmen had just signed and was again informed the public cannot look at that because there is personal information on it – it is for Selectmen only. Mrs. Moroney also reiterated that Mr. Strasser is the first person who has asked for this type of information and it is taking longer because we want to be sure we are doing what is proper and not giving out information that we are not supposed to. Selectman Mills stated Counsel also advised it is better to take a slower approach to assure the privacy rights are not breached while fulfilling our obligations under the RSA. Though Mr. Strasser was again looking for case law, Selectman Mills said he’d like to continue with the privacy issue and went on to say when he read the information from the LGC website, he thought all the information including sick leave was under the right to know. However, as a result of Attorney Whitelaw’s meeting, he has found out it is not to be released to the public and it is incumbent on us to be sure any information released is permissible. He also said the information is great to have, but the full context, such as Atty. Whitelaw had is much better. He told Mr. Strasser he would try to get case law information for him. Mr. Strasser returned to the matter of payroll backup on the table and wanting to look at it and remarked that when he submitted his first request to the office everything had been blacked out except the name and total hours. Selectman Mills, again, said there is personal information on it that the public cannot see and this was verified by their meeting with Town Counsel today.

As there was no further business, Selectman Moroney declared the meeting ended at 7:43 p.m. and moved to go into Non-Public Session for personnel. The Board was polled and went into non-public session.

At the close of Non-Public session, Selectman Moroney moved to return to public session and seal the minutes from Non-Public session.

There being no further discussion, Selectman Moroney made a Motion to: adjourn the meeting. Selectman Mills seconded and the Motion passed unanimously. Selectman Moroney declared the meeting ended at 9:40 p.m.
