Meeting Minutes June 11, 2009



“These minutes of The Town of Carroll Board of Adjustment have been recorded by its Secretary. Though believed to be accurate and correct they are subject to additions, deletions, and corrections by The Board of Adjustment at its next meeting when the Board votes its final approval of the minutes. They are being made available at this time to conform to the requirements of New Hampshire RSA 91-A:2”

Members of the Board present: Joan Karpf, Leslie Bergum, Pam Walsh and newest member, Bill Dowling

Members of the Public present: Linda Webb, June Marihugh

Meeting called to order at 7:06 pm

The minutes of February 12, 2009 were tabled because Joan and Leslie were the only two that were present at that meeting. The secretary was asked to also check the minutes for some items that may have been omitted.

Chairman Karpf stated that the board had before them an Application for an Area Variance from Linda Webb and June Marihugh. They explained that they would like to put up a carport on their property and that there is not a lot of room. The Chairman pointed out that the property size is .4 of an acre and it is a non-conforming lot.
She also brought in an article from the LGC on non-conforming lots for the board to read at a later date.

The Chairman asked the two owners if they could get to the board in the next two weeks, a map of their property with dimensions that showed the location of the house, setbacks of the house and setbacks of proposed carport. Using approximately 1”to = 10 feet.

The Chair asked for the list of abutters. The list and map and lots were checked to make sure that all abutters were listed. The list was confirmed.

The “Facts supporting this request”:
1. The proposed use would not diminish surrounding property values because: the structure is small in size and being built by a reputable contractor.
2. Granting the variance would not be contrary to the public interest because: it would blend with the surroundings (not an eyesore).
3. Denial of the variance would result in unnecessary hardship to the owner because:
a. the following special conditions of the property make an area variance in order to allow the development as designed as no other space is available
on the property; and (as suggested by the board to add) it is a non-conforming lot.
b. the same benefit cannot be achieved by some other reasonably feasible
method that would not impose an undue burden because same as above.
4. Granting the variance would do substantial justice because: we as senior citizens
would not have to shovel the snow and clear the ice from the two vehicles and
without the variance we would not be able to have it built.

5. The use is not contrary to the spirit of the ordinance because: the building is not
in contrast to the other buildings in the area (the building will fit in).


The board was asked if they had any question. Pam Walsh asked how high the structure would be. Neither of the owners knew the exact height of the carport. Chairmen Karpf asked to please have that when they come to the Public Hearing. It was stated that it appeared the carport would have one wall only.

There appeared to be no further questions, Chairman Karpf said she would entertain a motion. Bill Dowling made a motion: to accept the application pending the submittal of the map showing the height of the carport, setbacks, house and proposed carport of Map 206, Lot 56. Pam Walsh seconded, and the motion passed unanimously.

There being no further business before the board, Bill Dowling made a motion: to adjourn the meeting. Pam Walsh seconded, and the motion passed unanimously. The meeting ended at 7:22.
